The Historical Basis And Practical Dilemma Of German Refugee Law

This paper focuses on the huge refugee crisis in Germany.It is widely known that the refugee crisis is the most severe test Germany has faced since World War II,mainly because it has not only brought enormous challenges to the country's economic development and social order stability,the crisis has also been internalized into a great challenge to domestic law and constitutionalism in the process of continuous fermentation and upgrading."Those who are safe are not in 1st and those who are in danger are not in danger since 1st".This paper explores how the crisis arises,In which it mainly shows the institutional defects of the relevant legislation between Germany and the European Union,and Germany's violation of the principles of the European Union law and the basic Law and so on.In order to elaborate these problems,this paper is divided into four parts.The first part is the introduction,which mainly introduces the preliminary work of the thesis,including the raising of the questions;research basis and significance of refugee crisis;literature review on refugee problem written by scholars at home and abroad;the main research methods applied in this paper.The second part mainly focuses on the process of the construction of German refugee legislation system since World War II.This part is mainly divided into four periods to sort out the historical development process of how loose asylum policy at the beginning of the post World War II became strict and complex,until the present right of asylum is almost empty step by step.The third part focuses on the influence of refugee crisis on German domestic law and constitutional order.Mainly from this crisis,the construction of the country underthe rule of law,the game of anti-terrorism and human rights protection,and the integration of refugee society into three aspects,and with the help of the case of "banning political parties" and "refusing to go swimming with men and women" and other cases,further evidence of the refugee crisis has contributed to the great threat to the constitutional order established by the basic law of Germany.The 4th part focuses on the causes of the refugee crisis.This will be analyzed from the European Union and Germany.This part will not only examine the relevant laws and regulations and the implementation of the situation,but also take in-depth study of the causes of the crisis from the moral and national interests,political culture and other multi-dimensional levels.
