Research On Work Injury Insurance For Migrant Workers In The Construction Industry

Compo insurance is the “security net” for peasant-workers and an important part of the social security system.Its target is to protect the peasant-workers' rights of getting remedy for their accident injury from the society.Central government has already promulgated “Compo insurance regulation.” Ministry of Human Resources and Social Security also promulgated some legal documents like “Notice concerning peasants' compo insurance” to protect peasants-workers' rights.Usually,peasant-workers are not well educated,but his/her own family needs him/her work to support.Therefore,they prefer the high-income construction industry in job hunting.However,construction is a high-risk industry,and illegal subcontracts are common,which is not good to protect peasant-workers' legal rights like compo insurance.There is no special policy dealing with peasant-workers' compo insurance,let alone compo insurance policy concerning peasant-workers in construction industry.There are many problems about present compo insurance system for construction industry peasant-workers,the main examples of which are: insurance rate is low;peasant-workers are not willing to buy insurance;there are unreasonable flaws in compo insurance system;procedures of compo insurance application is complicated;it takes long time to apply for the compo insurance treatment;the lack of inspiration system for compo insurance.The core content of this paper is: it is the city-countryside residential system of our country that causes it difficult for construction industry farmer-workers to acquire compo insurance;government's main purpose is the increase of GDP,so farmer-workers' right protection is ignored,by which farmer-workers' situation becomes worse and worse.In order to protect farmer-workers' legal rights,relevantlegislation should be completed;the revolution of residential system should be improved;government's responsibility and enterprises' social responsibility feelings should be strengthened.This paper first claims that peasant-workers are the key power supporting economic development of our country.Thus,the problems of peasant-workers' right protection should be seriously considered.Compo insurance,as one of the most basic parts of social security,should open gate for peasant-workers.Second,the author takes her own cases as examples to explain the problems that peasant-workers in construction industry meet when searching for compo insurance treatment.Third,this paper explains that the reasons why it is difficult for compo insurance to cover construction industry peasant-workers is the city-countryside residential system of our country,and suggests the revolution of this residential system.At last,this paper points out that the increase of compo insurance rate for construction industry peasant-workers depends on four aspects: legislature,government,enterprise and peasant-workers.
