Research On The Legal Issues Of Precision Poverty Alleviation In Tibet

Eradicating poverty and achieving common prosperity have been the lofty ideals pursued by mankind for thousands of years and the essential requirement of socialism.Since the founding of the People's Republic of China,China has attached great importance to poverty alleviation work.Especially since the reform and opening up,China's poverty alleviation and development work has been characterized by strong planning,perfect organizational system and large-scale development.In terms of the effectiveness of poverty alleviation,the number of poverty-stricken people in China has been decreasing year by year,and remarkable results have been achieved in poverty reduction.However,after the 18 th national congress of the communist party of China,in order to ensure the building of a moderately prosperous society in all respects by 2020,China's poverty alleviation and development work has also entered a new period of targeted poverty alleviation.The proposal of this new poverty alleviation strategy,on the one hand,marks the new normal of poverty alleviation and development work,and on the other hand,reflects the fundamental characteristics of poverty alleviation work.How to better promote targeted poverty alleviation in a standardized and scientific way,and how to make targeted poverty alleviation achieve long-term and stable results of poverty alleviation are all major problems faced by targeted poverty alleviation.Practice has proved that continuous promotion of legalization can fundamentally guarantee the implementation of targeted poverty alleviation strategy.For a long time,our country although had some positive exploration in terms of poverty alleviation under the rule of law construction,there are some successful experiences,but Tibet general local legislation construction still lag for poverty alleviation,legal protection for targeted poverty alleviation remains to be perfect,legislation,law enforcement,judicial,law-abiding rule-of-law level is still low,which seriously hindered the development of targeted poverty alleviation smoothly.Starting from the concept of targeted poverty alleviation and its legalization in China,this paper takes the local legislation on targeted poverty alleviation in Tibet as the research object,aims to discuss the necessity and importance of implementing the local legislation on targeted poverty alleviation in Tibet from the perspective of legal construction,and explore the local legislation on targeted poverty alleviation in Tibet.Based on the problem of Tibet local legislation of targeted poverty alleviation as the research object,according to the chapter,the first chapter is the introduction part,clarified the selected topic background,research significance of this paper,some of the existing literature on the combing and summary,put forward the study of the framework and methods of Tibetan local legislation for targeted poverty alleviation.The second chapter from the national level to comb the provinces and cities legislation status;It also discusses the similarities and differences of the legislation of various provinces and cities in China from four perspectives: the simplification of the main body of poverty alleviation,the overly strong color of administrative,the strong policy,the lack of establishment of poverty alleviation structure,the similarity and simplification of legal responsibilities,and the author guesses the legislative trend of targeted poverty alleviation and the necessity of local legislation of targeted poverty alleviation in Tibet from the author's own perspective.Chapter three is Tibet operation and legislative status of targeted poverty alleviation,and found the seven problems in the poverty alleviation work in Tibet: lack legal system,the local regulation of targeted poverty alleviation copy from the superior regulations,no guidelines of residency work for targeted poverty alleviation,targeted poverty alleviation work lack of supervision mechanism,poverty alleviation funds operation lack of legal constraints,the poverty alleviation work in the language communication,the high chance of poverty-returning in Tibet;This paper analyzes in detail the problems in the work of poverty alleviation in Tibet,which indirectly shows the necessity of local legislation in Tibet.The fourth chapter analyzes the problems and causes of local legislation on targeted poverty alleviation in Tibet,mainly from the aspects of imperfect legislation,inadequate management,irregular law enforcement,lack of judicial authority and imperfect supervision mechanism.The fourth chapter is the overseas experience of anti-poverty legal system.It analyzes the anti-poverty system of Britain,Germany,the United States,India,and Latin America for reference to the local legislation of Tibet.Fifth chapter is Tibet local legislative Suggestions for targeted poverty alleviation,mainly promote autonomous legislation,regulating the behavior of the autonomous region government in accordance with the law,standardize residency behavior,improve the supervision mechanism for targeted poverty alleviation,improving the level of public law Tibetan culture,the prevention of poverty-returning group out of poverty.
