Research On The International Governance Of Cybercrime

With the development of the network era from the 1.0 era to the 2.0 era,and is rapidly developing towards the 3.0 era,the network space has been formed.Cyberspace not only provides efficient and convenient life for everyone,but also provides a platform for the breeding of Cyber Crimes.The governance of cyber crime in the international community mainly depends on two forms of international treaty mechanism and international organization mechanism.The Budapest treaty as the most representative of the international treaty is,by the European commission to make early and influence range is relatively wide regional treaties,cannot be ignored,the convention on the principle of jurisdiction of cyber crime,cyber crime concept,the definition of relevant criminal substantive law and procedural law,international cooperation and a series of plane has made the related regulation and explanation.However,due to the long years of its establishment,the relevant treaties cannot meet the needs of the new Cyber Crimes governance,and the relatively complex provisions of the rules modification have led to the treaty has been in a state of stagnation.In terms of international organization mechanism,Interpol has been playing an important role in the technology of Cyber Crimes governance,instead of focusing on the formulation of relevant governance regulations.Other international organizations,which mainly take the form of conferences,reports,surveys and studies,have not received special attention because of their lack of enforcement.At present,cyber crime is increasingly rampant,which not only endangers the personal security of citizens,but also national security and military security.With the research on the international governance of Cyber Crimes as the theme,we can see that neither the international convention similar to the Budapest convention on Cyber Crimes nor the conference resolutions of relevant international organizations have achieved the effect of effectively governing Cyber Crimes and protecting relevant rights and interests.At present,there is no universal and authoritative international governance standard in the world.In view of the above problems,this paper proposes the formulation of international Cyber Crimes governance treaty led by the United Nations,and hopes that the United Nations Cyber Crimes governance convention can better protect relevant rights and interests.
