With the rapid emergence of a new generation of information technology,which provides a new power and engine for economic development,IBM president proposed the concept of "smart city" in 2009,aiming to use Internet of things,cloud computing and other technologies to improve the level of urban management,meet the people's yearning for a better life and promote economic development.The emergence of this concept has also produced new expectations and new visions for the future urban life of governments and people who are facing increasingly serious "urban diseases"(such as urban traffic congestion,population expansion,resource shortage,serious environmental damage,etc.).It is with this good vision for the future sustainable development of the city that the concept of smart city is gradually being expanded Accepted by the government and the public,there is a global upsurge of building smart cities.In order to realize the healthy and stable development of smart city,we should not only rely on the technical means of informatization,but also need legislation as the backing to ensure the realization of smart city.Although the construction of China's smart city is at an early stage,looking back at various legal issues in the Internet era,it is not alarmist to think about the legislation of smart city now.Without a scientific legislative system and policy theoretical guidance,the consequences of such a complex system project will be unimaginable and even lead to the construction of smart city going astray.Therefore,the legislative construction of smart city needs the guidance and attention of scholars and legal workers.This paper clarifies the theoretical concept through the literature research method,compares the development process inside and outside the domain through the comparative analysis method,analyzes the current situation and problems of China's smart city legislative construction with rational thinking,and puts forward solutions to the problems.The full text includes four parts besides the introduction.The first part of the first chapter analyzes the concept of "urban disease" through the views of relevant scholars,and introduces the specific performance of "urban disease".The second part compares the views of some scholars on the smart city.The first kind of views only tend to "wisdom",the second kind of views tend to "wisdom",the third kind of views are both "wisdom" and "wisdom".Through the three kinds of views The comprehensive analysis of points leads to the definition of smart city in this paper,and profoundly reveals the construction goal of smart city.The third part describes the effectiveness and shortcomings of the governance of "urban disease" in the construction of smart city.The second chapter lists the current central legislation and local laws and regulations in our country,through the analysis of the current problems faced by the construction of smart city legislation in our country,and analyzes these problems in depth to clarify the causes of the problems.The third chapter compares the legislative construction of smart cities in and out of China,and analyzes the differences between China and foreign countries in legislative concept,application field,legislative supervision,legislative level,implementation mode,research angle,etc.it requires that China should learn from the excellent experience of foreign countries,and carry out legislative construction of smart cities in accordance with local conditions.The fourth chapter puts forward some suggestions from the aspects of legislative concept,legislative system,solving traffic congestion,strengthening urban infrastructure,strengthening urban health and greening.
