Governing the country in accordance with the law is the main line of our country’s strategy.Whether it can achieve the ideal state of rule of law and form a good social order depends on many factors.The most important factor is whether the field of education can achieve rule of law.Primary and secondary school teachers,as practitioners,propagandists and promoters of teaching by law,their own level and ability to teach according to law directly affect the process of teaching and ruling school by law,as well as prevention and treatment of campus safety,teacher and student rights,and educational disputes.As a result,it is aligned with the policy to study the current situation and problems of primary and secondary school teachers’ teaching according to the law,which has important theoretical and practical significance.In this study,the current situation of law-based teaching by elementary and middle school teachers in District G of N City is taken as the research object.On the basis of fully sorting out and analyzing the relevant literature and policy texts for teachers to teach according to law,the questionnaire and interview outline are designed from three aspects: the status quo of cognition of laws and regulations,the status of teaching according to law and the status quo of managing schools according to law.The outline of the interview selected 1500 teachers and 55 leaders from 33 schools in G area as respondents for the questionnaire survey.Semi-structured interviews were conducted with 10 primary and secondary school teachers and leaders.The discussions on the teaching of primary and middle school teachers in G area according to law were conducted.The status quo and existing problems,and analyze the causes of the problems from the level of habitual power,legal level,school level and teachers themselves;finally,strategies and suggestions are put forward to help primary and secondary school teachers teach according to the law.The study found that the general level of teaching of primary and secondary school teachers in the G area is good and most teachers can meet the requirements of the rule of law from legal cognition,awareness and behavior.There are significant differences in variables such as gender,whether to be a class teacher or not,teaching section and teaching subject.Although there are no significant differences in variables such as teaching age,academic qualifications and professional titles,there are generally significant differences in legal behavior.In addition,the level of primary and secondary school teachers teaching according to law and is in correlation with the management of schools by law and the level of teaching by other teachers in this school.Based on the interviews,the main experiences of teachers in primary and secondary schools in the G area in accordance with the law are as follows: building a multi-party collaborative platform to improve teachers’ legal literacy,focusing on the combination of teacher ethics construction and education legal literacy training,incorporating law-based teaching into the scientific assessment mechanism,etc.However,there are also some problems.For example,the understanding of laws and regulations of primary and secondary school teachers is not systematic and comprehensive,some primary and secondary school teachers have insufficient ability to handle legal disputes and some teachers’ legal behaviors of primary and secondary schools need to be regulated.The main reasons for the problems are: the influence of customary power,the problems of laws and regulations,the law popularization and law enforcement in schools and the weak legal awareness of teachers themselves.Studies have suggested that the status quo must be explored from three aspects: the state,schools and teachers to improve the way teachers teach in accordance with the law.To begin with,actions must be taken to improve education laws and regulations,establish a strict and fair education enforcement system,improve the dispute resolution mechanism in education and improve and implement teacher treatment.Secondly,it is a must to cultivate campus culture according to law,strengthen training for teachers in teaching according to law,establish a community of teaching practice according to law and improve the system of teaching supervision.At last,it is of great importance to consciously establish a sense of teaching in accordance with the law,strengthen the study of education laws and regulations and consciously be a practitioner of law.
