Research Of The Reason And Solution On The Illegal Consumption Of The Ecological Land At Wuhan

During the increasing process of the industrialization and the urbanization process in China,the contradiction of the land supply and demand becomes sharply and the illegal land issues becomes more and more serious.To manage the scarce land resources and improve the utilization of the land has an important meaning to the construction of the new urbanization and the sustainable development.Since 1990 s,domestic and overseas scholars have take up a lot of researches focused on the Chinese illegal land issues by several aspects,such as the illegal subjects,the illegal factors,the illegal ways and the solutions.However,the illegal consumptions of the ecological land do not draw the experts’ attentions.Considering the fact that the urbanization process has already been the rapid development period,which means the contradiction of the land supply and demand will be compounded,the illegal land phenomena becomes more and more serious.The cultivated land has been harmed and the ecological land has been worn.The ecological land is different from the other land types.Once it is worn,it could be hard to recovered.Paying attention to the illegal ecological land using phenomena has an important meaning to make the urbanization process become reasonable and orderly.The study object in the thesis is the ecological land in Wuhan and the research is focused on the causes and countermeasures of the illegal consumption of the ecological land during the urbanization process at Wuhan.The thesis analyzes the cases of illegal land phenomena at Wuhan during 2010 to 2015 and the cases happened in China during 1999 to 2013.The thesis also compares the land resource utilization and the land area change trends at Wuhan and at the whole China during the same stage in order to find the features of the illegal consumption of the ecological land.With the analysis of the typical cases of the illegal ecological land using phenomena proposed by the land supervision department of Wuhan,the thesis concludes the current status,the regional distribution of cases and the reasons of the illegal consumption of the ecological land at Wuhan and finally proposes the corresponding management policies to the illegal ecological land using phenomena.The major conclusions are as follows:(1)The illegal cases in land during the 1999 to 2013 period in the whole country and during the 12 th five-year plan period at Wuhan both show the dynamic fluctuation trend with the cyclic variation to rise and fall again.The amount of the difference between the involved land area and the involved cultivated land area are in a high level in two samples with the fact that the amount of the involved cultivated land area is reduces in two samples.During the process of the illegal land using,the other types of the lands also suffered the illegal consumption excepted the cultivated land.The variation tendency of the number of the illegal land using cases and the area of the involved land in two samples is the same as the using process of the land resource in the whole country during the 2005 to 2013 period and at Wuhan during the 2010 to 2015.(2)To analyze the cases of the illegal ecological land using phenomena proposed by the land supervision department of Wuhan and explore the spatial location distribution of the cases’ geographical position,the result shows that the illegal land using cases with the ecological lands scatters in the surrounding areas of Wuhan.The major participants of the illegal ecological lands using are the local government and the local enterprises with the main formation of the illegal approval of the land using and the illegal occupation of the land.(3)The illegal ecological land using at Wuhan is caused by the five major factors.The most important one is the weak awareness of the ecological lands protection caused by the unclear concepts of the ecological lands and the underestimated value of the ecological lands.Also,the unclear property rights of the ecological lands compared with other land types is an essential reason of the illegal ecological land using.Considering the fact that the ecological land belongs to the public products,the local government’ s connivance of the illegal ecological land using caused by the economic reasons could not be ignored.If the local government took part in the protection of the ecological lands,the possibility of the illegal consumption of the ecological lands will be reduces obviously.Furthermore,the deficient land management law is a reason to cause the illegal ecological lands using.Finally,the absence of the land monitoring system makes the illegal ecological using cases be possible to increase.(4)Focused on the reasons of the illegal ecological lands using cases,the thesis provides the specific resolutions in five aspects,to enhance the protection of the ecological lands by defining the concepts and the status of the ecological lands,to regulate the property right system of the ecological lands,to clarify the responsibility of the government organization,to improve the integrity of the legal responsibility of the lands by expanding the scope of the main body of the land responsibility and by increasing the intensity of the land law,also to improve the land supervision system.
