The history of the Section 301 of the United States on the rest of the world began in the mid-20th century.Since the 1960s the United States has adopted the 301 Survey,through which the emerging European Community has been successfully suppressed.Subsequently,the use of the "trade war" hit the Japanese economy,and achieved the goal of making Japan's automatic export quota concessions.Since then,because the United States believed that China threatened the international status of the United States,it has implemented Special 301 four times and reached three intellectual property agreements with China in different degrees.The purpose of this provision is to safeguard and promote American free trade and combat unfair trade.The U.S.trade deficit with China is one of the important reasons for the resumption of the 301 investigation in the United States.However,this unilateral action of the United States not only violates the relevant provisions of the WTO,but also violates China's legitimate right to trade.At present.the scale of China's foreign trade is huge,and the trade with the United States involves a wide range of industries and products is incalculable.At this critical point,the introduction of the 301 clause in the United States will greatly affect China's development process.This article aims to perfect the "301 clause" of the United States on the basis of domestic and foreign scholars' research,so as to improve the foreign policies and policies in line with China's current international and domestic political and economic background,and to respond more effectively to the new round of "301 investigation" in the new era.
