With the national revitalization strategy of rural economic development,the rural land reform centered on the "three powers division" came into being.Under the vigorous promotion of the government,agricultural land management right mortgage as an effective measure to activate agricultural land finance and crack loan difficulty under new situation,the pilot area work progressed smoothly.Based on the general analysis path of theoretical analysis-practice investigation-system improvement and supported by basic theory and basic concepts,this article explains the theoretical logic and market operating development of agricultural management right mortgage systematically through reviewing the literature on mortgage loans related to agricultural management rights at home and abroad.The premise of the theoretical logic explanation is to define the property of agricultural land management right.This paper defines the different nature of agricultural land management rights as usufructuary property based on the theory of disputes and realistic considerations.Meanwhile,following the path of institutional change,this study discusses the institutional connotation of the agricultural land management right mortgage propertyization in essence under the basis of the internal logical mainline of the subdivision of land rights-empowering empowerment-agricultural mortgage.The deep interpretation of the logic theory is to better support the development of the market.Through the analysis of the operation and development of the mortgage loan market,it is concluded that the mortgage loan of agricultural land management has the market mechanism of heterogeneous mortgage,diversification of mortgage mode and high level of risk prevention and control.The development of the market gave birth to the eagerness of the mortgage pilot area.In order to verify the theoretical logic and market operation,this paper selects JinHu experimental area as the selection case.Through learning about the reform of the mortgage loan in this pilot area,under the detailed description of the mortgage operation mechanism,this paper analyzes the mechanism operating procedures and its incentive prevention with the disposal of breach of contract in deep analysis and parses in-depth discussions on the problems existing in the pilot aera operation.At last,based on the theoretical discussion and practical investigation,this paper discusses and explores the improvement of mortgage loan system of agricultural management right from the general principles of institutional construction,the main points of institutional construction and the procedures of institutional construction.And for the problems in the pilot area,this article puts forward the multi-faceted formulation of perfect institutional design for mortgage loan system of agricultural management right from the legal revision,the circulation market construction,the social security system consummation and reduces the government operation cost,so as to provide guidance and reference for the practice of mortgage loan for agricultural land management.
