Problem Analysis And Countermeasure Research On Contract Risk Management Of A Project

With the more and more frequent cooperation between project subjects,in order to protect the interests of all parties,the status of contract management in enterprise management is more and more prominent,contract management becomes the key to the success of the project.Especially for large-scale projects,the construction period is longer and there are many uncontrollable factors,so higher requirements are put forward for contract management.In addition,there are certain differences in various aspects among the participants of engineering projects,as well as complex legal relations,It makes the relationship between the responsibilities and rights of the parties involved in the contract more vague,and the intervention of human relationship makes the contract management more difficult,which affects the realization of the overall goal of the project.This study takes contract management as the main line of research.Firstly,on the basis of elaborating the relevant concepts and theoretical knowledge of contract management,taking a project as the main case,this paper analyzes the favorable conditions for the development of a project and the difficulties of contract management,and focuses on the types,types and characteristics of project contracts Contract management should follow the system and procedure,the organizational structure of contract management and contract planning.Secondly,the paper analyzes the causes of the problems in several stages,such as the lack of reasonable bill of quantities,the lack of scientific evaluation method,the contempt of evaluation and the emphasis on scoring in the process of evaluation;In the contract signing stage,the signing of the contract lacks rigor and the contract text lacks rationality;In the stage of contract performance,the supervision of contract performance is ignored,the project change is not real enough,and so on.These problems have potential risks.At the same time,it analyzes and demonstrates the sharing of contract risk.In view of the problems in each stage of contract management,this study puts forward targeted measures from three aspects: the management before the contract signing,the work in the process of contract implementation,and the work of contract evaluation.This study makes a comprehensive analysis of the problems of contract management,discusses the effective mode of contract management,and looks forward to the problems that need to be further studied in the field of contract management,which can provide some reference for the contract management of other industries,and has very important theoretical and practical significance.
