In ancient China,the distribution of prisoners played a very special role in consolidating political power and maintaining social stability.Under the guidance of the legislative principle of "consulting the Han for the Jin Dynasty",the Qing Dynasty "formed a system of exile in which banishment was the right punishment,and military recruitment,migration and dispatch were the leap punishment".In the process,the Han People’s legal consciousness was absorbed,compiled the Jun Wei Dao Di Biao,San Liu Dao Li Biao,in turn,it also directed the distribution of prisoners.The revision of Dao Li Biao in the three dynasties of Qian Long,Jia Qing and Tong Zhi reflects the adjustment of the contents of Dao Li Biao by the Qing Court,and also reflects various practical problems in the use of Dao Li Biao.And for the table of the problem to deal with and deal with,is the Dao Li Biao the application of the expression.Dao Li Biao is only used for the compilation and distribution of military flow in the interior,and it has specific scope of application,namely,the subject,the place and the behavior.The criminals in the circle of Dao Li Biao have a "circle" character in the legal level,and form "one center,five circles",that is,the ideal type of "circle",the core of this theory is that the military flow is gradually postponed from the center to the edge according to the gravity of the crime,which inherits the ancient thought of "four evils of military flow",that is to say,the people in the exile center will go to the border to carry out the education.However,in the process of judicial practice,there is a big gap between the irregular military circles formed in the places where the prisoners are confined and the ideal ones.Taking various editions of Dao Li Biao as the center,this paper probes into the time and space distribution and its causes of formation of the "smoke and malaria land" in the Qing Dynasty,and analyzes that nature,politics and coastal defense security are the important factors influencing the evolution of the "smoke and malaria land" distribution in the Qing Dynasty.Most scholars have limited their understanding of tobacco and Malaria to the fact that tobacco and Malaria are the highest punishment formilitary campaigns,and "tobacco and Malaria Land" is distributed in remote areas with bad soil and water,however,in Dao Li Biao,"smoke miasma ground" appears to be densely distributed from the areas of Tusi and harsh environment to the areas along the main lines of communication and in the more developed areas,this distribution pattern shows that the places where the army committed malaria crimes are the areas where the state power is in-depth and local governance is relatively perfect,reflecting the will of the development of the state-led exile system. |
