With the rapid development of China’s economy,adapting to China’s current conditions,meeting the "people’s needs for a better life",and achieving "people’s happiness" have become the most fundamental value criterion for testing socialist ideas with Chinese characteristics in the new era.Happiness is a matter closely related to human rights.Of course,the gap between ownership and realization cannot be ignored,which means that it is one thing for all people to have human rights,and the actual protection of human rights is another.Therefore,it does not mean that all people have the right to pursue happiness so that they can achieve their happiness.However,everyone should be guaranteed to pursue their own happiness through efforts without infringing on the human rights and happiness of others.The influence of Confucian culture on Korea’s ethical system,social life,and national laws is deeply ingrained.As a friend of Confucian culture,South Korea’s theory of the right to pursue happiness has gone through decades of practice.The essence of it and the lessons learned in the development process are worthy of our reference.Through the origin of the right to pursue happiness,this paper shows the relevant provisions on the right to pursue happiness in foreign countries.Since there is no clear legal provision on the right to pursue happiness in China,this paper summarizes the necessity and feasibility of the theory of the right to pursue happiness in China through the analysis of the theory and precedent of the right to pursue happiness in South Korea.In this paper,the first chapter mainly discusses the research purpose,research background and research status at home and abroad.The second chapter mainly summarizes the right to pursue happiness,including the meaning of happiness and the origin of the right to pursue happiness,that is,the relevant provisions of foreign countries on the right to pursue happiness.The third chapter mainly expounds the connotation of the right to pursue happiness in South Korea.It mainly covers the background of the establishment of the system,as well as the content and legal attributes of the right and the relationship with other basic rights.The specific case of the Constitutional Tribunal shows the connotation of the right to pursue happiness in Korea more intuitively。The fourth chapter is mainly about the enlightenment of the right to pursue happiness in South Korea to China and the ways to confirm it in China,to seek the way of confirmation through the necessity and feasibility of confirming the right to pursue happiness.The fifth chapter is a brief summary of the full text.
