Research On Legal Issues Of Online Shopping Safety Regulation In China

According to the data from China Internet Network Information Center,the total scale of online shopping in China has exceeded 30000 billion yuan in 2016.The total amount of online shopping is 75 billion yuan,which accounts for 2.5% of the total transaction volume.It has become one of the most important sales products in the Internet market.With the rapid development of the Internet food market,Internet food safety problems emerge one after another,and the food safety problem that has been at the cusp has once again become the focus of social attention.In order to protect the safety and health of consumers of online shopping,and guide food enterprises to produce,operate and sell in a reasonable,safe and orderly way,the state has issued relevant laws and regulations to make the online shopping safety supervision work have a legal basis.In 2015 the new "food safety law" for the first time on online shopping food added detailed terms,including: the third party trading platform food network to network real name registration manager;to review the food business license;network operators have found violations,should be promptly stopped,and immediately report the food regulatory authorities found serious violations;behavior,should immediately stop providing online trading platform services etc..The implementation of the new law helps the students of law majors to study the legal issues of the food safety supervision of online shopping from the legal point of view.The research contents of this thesis are divided into five parts: first,the first part of the thesis is drawn from the case.The first part is an overview of the relevant theories of online shopping safety supervision.First of all,the connotation of food safety supervision and online shopping food safety supervision is defined,followed by an analysis of the characteristics of online shopping food safety supervision.Secondly,it analyzes the subject,object and content of online shopping safety supervision.Thirdly,it analyzes the legal basis and realistic basis for the safety supervision of online shopping.The problem of food safety will involve the interests of many related people.In seeking the effective implementation of the food safety supervision,we should not only consider the legal and economic factors,but also consider the other multiple factors.The second part introduces the current mode of food safety supervision in China.There are three main modes of food safety supervision at the present stage in China-the supervision mode of "network management network",the supervision mode of "government and Enterprise Co governance" and the supervision mode of "social co governance".The third part is the current situation and problems of online shopping safety supervision in China.First of all,from the legislative status quo,law enforcement status and judicial status quo three aspects of research,looking for loopholes and deficiencies.Because of the law of flood detention,our food safety law is developing constantly,but many problems in reality also need theoretical guidance.From the three angles of legislation status,law enforcement status and judicial status,the problems of food safety and the actual situation of supervision in China are discussed in order to put forward the path of supervision and implementation.The present situation of legislation mainly includes the existing legal basis of food safety supervision in China.The content of law enforcement is mainly from the current stage of our network.The law enforcement of the food safety supervision department and the way of law enforcement are analyzed in two aspects.The content of the judicial status is mainly described from the actual situation of the current judicial practice of the online purchase of food.Secondly,it analyzes the four problems in the food safety supervision in China-the imperfect laws and regulations on the supervision of the food safety,the unsound supervision system of the third party platform for online shopping,the unreasonable allocation of the food safety supervision department and the irregular procedures for the supervision of the food safety.The fourth part is to improve our online shopping safety supervision measures.According to the third part of China's online shopping food safety supervision of four problems,find out the corresponding measures.The fifth part is a summary of the full text,and puts forward the prospect of online shopping safety in China.
