Research On Optimization Of Local Legislative Collaboration Mechanism

Regional cooperation in local legislation is a realistic response to the development of regional economic integration.In order to coordinate the conflicts of interest between the various administrative regions and eliminate the negative effects of the split-type local legislative system,the local legislative bodies began to carry out legislative collaboration with a view to creating a coordinated legal environment between local legislation and providing laws for regional governance.However,the current regional legislative cooperation in China faces many problems and its role cannot be fully exerted.Therefore,it is necessary to optimize the regional legislative cooperation mechanism in China.The premise of optimizing the regional legislation cooperation mechanism in China is to clarify the concept,status and realistic basis of regional legislation cooperation.Local legislative collaboration means that different local legislative bodies at the same level in a specific region coordinate local legislation through mutual and equal exchanges in order to promote the development of regional economic integration,to manage regional public affairs and realize regional common interests.In the current legislative system of our country,regional local legislative collaboration is actually a local legislative activity,which exercises local legislative power,and its realistic basis lies in the objective trend of regional economic integration and the conflicts between local legislation in the region.Although in the three eastern provinces of China,Beijing-Tianjin-Hebei,the Yangtze River Delta,and the Pearl River Delta,local legislative cooperation has been carried out by relying on the soft-law approach of the legislative cooperation agreement,and has achieved certain results,but it lacks the basis of higher-level law and the cooperation body is single.Problems such as loose collaboration,insufficient motivation,and lack of systematic cooperation still need to be resolved.Guided by solving the above problems,the way to optimize the regional legislative cooperation mechanism is to choose a legislative cooperation model suitable for our country,and on this basis,improve the top-level legislation,establish a perfect legislative cooperation system,improve the incentive and restraint mechanism,andbuild a full process legislative cooperation mechanism.
