| “A bowl of rice is the concern of a myriad of families;the fuel,rice,cooking oil and salt have close relationship to people’s livelihood.”Food safety is the concern of thousands of families and is closely related to People’s daily life.More importantly it is directly related to everyone’s health and happiness,it is the livelihood issue on the dining-table and safety issue on the tongue.However,for the past few years,China’s food safety accidents occurred one after another,resulting in the reduction of people’s trust in food safety and the questioning of the credibility of the government.All this is inseparable to the imperfection of our country’s food safety administration law enforcement system.In order to adapt to the new market supervision situation,the government makes a new round of institutional reform.In March 2018,it clearly claimed in the document <> issued by the central committee of the communist party of China that State Administration for Market Regulation should be founded,and there should not be State administration of industry and commerce、State general administration of quality supervision,inspection and quarantine、State food and drug administration any more,and comprehensive enforcement of market regulation should be promoted further.The comprehensive enforcement of market regulation has solved the difficult problems of law enforcement by multiple institutions at several levels and repeated law enforcement that have long troubled the law enforcement of food safety at the basic level.Nevertheless,the food safety issue at the basic level is still prominent,and there are still some problems :the law enforcement force is weak,the law enforcement procedures are not standardized,and the law enforcement guarantee is not sufficient.In February 2019,the general office of the CPC central committee and the general office of the state council issued 《The provisions on food safety responsibility system for local party and government leading cadres》,which emphasized the importance of food safety in the comprehensive law enforcement of market regulation and ensured the steady improvement of the modern governance capacity and level of food safety.Taking G area as an example,this paper studies how to improve the food safety law enforcement at the basic level in the context of perfection of comprehensive law enforcement,making an effort to improve the efficiency of food safety law enforcement at the basic level.According to the research strategy of finding-analysis-countermeasures,it takes the food law enforcement of G area of City X in Sichuan Province as the research object.It firstly analyzes the research background and significance.Then with the author’s food safety law enforcement experience it searches the problems of food safety law enforcement from the four aspects of the object of law enforcement,law enforcement force,law enforcement process and the external environment in G area,through the methods of case analysis,comparative analysis,document review,and drawing lessons from advanced food safety law enforcement experience of the United States,the European Union,Japan,Chinese Hong Kong at the same time.It then analyzes the reasons from the the aspects of the consciousness of practitioners in rural areas,the integration and construction of law enforcement force,the legal system,the reduced cohesion law enforcement for the poor people,proposing to improve the ability to ensure food safety in G area by strengthening the leadership of the local party committee,strengthening the construction of law enforcement force,optimizing institutional arrangements,exploring the smart regulation,strengthening social governance,in order to remove the shortage of the food safety law enforcement system under the background of the comprehensive law enforcement in G area.It also makes efforts to provide reference for the administrative law enforcement in order to solve the problem of food safety at the basic level in our country. |
