At present, the circulation market is inundated with forged and fake commodities and foods, and this situation, which threatens people’s health and life, remains incessant. Thus, it is of great and profound significance to strengthen the comprehensive enforcement of administrative business law practice. The business administrative law enforcement work in Huainan started from the1990s. On January1,1998, the State Council promulgated The Regulation of Pig Slaughtering, along with which, Huainan started the administrative law enforcement work of pig slaughtering, and took the lead in establishing a brigade of pig slaughtering in Anhui province. Since2005, the liquor circulation law enforcement and the refined oil market law enforcement work has been enforced successively. In2009, Huainan took the lead in the second batch of business comprehensive law enforcement pilot city across the country, as an official prelude of commerce comprehensive law enforcement pilot work.The livestock market inspection team in Huainan was founded in1999, as a public service unit form, authorized with20staffs. In2011, according to the principle of "simplified, uniform and effective", leading by Municipal Bureau of Commerce undertaken the business of administrative law enforcement functions,"Huainan city business comprehensive law enforcement detachment" and "12312Huainan business report the complaint service center" were approved to establish by the Municipal Public Bureau, co-working with the Huainan Municipal Bureau of Commerce Department offices, which in a word, was a system with three names. The management model of Huainan business comprehensive administrative law enforcement is hierarchical management under the combination of city level and district level, embodying the principle of localization management and management squatting. This model determined the duties of city and district level in administrative law enforcement, repeating, dynamic enforcement work to the district level, while regional, mobile and highly-professional enforcement work to the city level. Meanwhile, business administrative law enforcement is connected with criminal to ensure the strict law enforcement and timely penalty system, encouraging the efficiency of the business administrative law enforcement, and also, the coordination mechanism with other law enforcement departments has achieved good results.But there still remain many unsolved problems during Huainan business law enforcement work, like, non-standard enforcing authority organization system, temporary law enforcement personnel with low quality, lack of funding and unperfect law enforcement supervision system.Aiming at these problems, Huainan business law enforcement agencies should reinforce the implementation of relevant laws and regulations; improve law enforcement personnel as well as the staff quality; complete the multi-sectoral joint enforcement mechanism of Huainan business comprehensive law enforcement; guarantee the fiscal funds of Huainan business integrated law enforcement agencies; improve the supervision mechanism of Huainan business integrated law enforcement agencies. And as a pilot city, Huainan should explore a way to reform and innovate the comprehensive administrative law enforcement system actively; carry out relatively concentrated administrative punishment and administrative licensing, etc; establish collaboration among departments and the joint meeting system, streamlining and law enforcement team to improve the efficiency of law enforcement.Through investigating and analyzing the current situation of Huainan business comprehensive law enforcement, I combine the theory with Huainan business comprehensive law enforcement status issues and also my personal perception through personal practice and observation. Analyzing the problems in Huainan business comprehensive law enforcement, I get a self-approval solution to deal with the current problems, in order to better solve the problems in practical work, as well as provide a reference for future work. |
