| Marx’s thought of the rule of law is an important part of Marxist thought of the rule of law.This paper will comprehensively clarify the theoretical source of Marx’s thought of the rule of law in chronological order,and clarify the realistic basis of Marx’s thought of the rule of law.Marx’s thought of rule of law comes from the theory of decentralization and people’s sovereignty of British and French Enlightenment thinkers,the theory of right law of German classical philosophers,the theory of the relationship between civil society and the state,and the theory of utopian socialists’ conception of rule of law in the future.On the basis of inheriting the predecessors’ theory and thinking about the capitalist system at that time,Marx’s thought of rule of law gradually came into being.The content of Marx’s thought of rule of law is mainly reflected in the period of Rhine newspaper.During this period,Marx published the debates on the law of forest theft,on the recent book and newspaper inspection order of Prussia,and on the freedom of the press and the publication of the minutes of the class meeting.During this period,Marx severely criticized the hypocrisy,narrowness and limitations of the rule of law under the bourgeois system,and pointed out the serious shortcomings of the bourgeois legal system at that time.Another content of Marx’s thought of the rule of law is in the conception of the future socialist rule of law system.By expounding the essence and development law of law,Marx pointed out the necessity of implementing the rule of law in the transitional stage of communism,and also constructed the construction of the future social rule of law system.In Marx’s Contemporary Enlightenment,we must first adhere to the socialist rule of law,resolutely not take the road of bourgeois rule of law,adhere to the people-centered,adhere to the party’s leadership,constantly improve the socialist rule of law system with Chinese characteristics under the background of rule of law,and realize the modernization of national governance system and governance ability. |
