The Construction Of Legal Professional Community In China

The legal professional community is one of the standards to measure the level of the rule of law in a country.It mainly refers to a special social group composed of judges,prosecutors,lawyers and legal scholars.It has the same legal education and professional ethics,using the same legal language and interpretation system.It is a community of undertakings,skill and interests.For the first time,the Fourth Plenary Session of the 18 th National Congress of the Communist Party of China specially studied and deployed the general plan of comprehensively promoting the basic rule of law in the form of plenary session,and proposed to build a socialist legal work team loyal to the party,the Chinese state,the people and the law.The legal professional community has been discussed enthusiastically by the academic community.Especially at present,our country advocates to optimize the business environment,which provides space for development for our country to build a legal professional community.In this paper,comparative analysis,literature analysis,investigation and research methods are used.Comparing and analyzing the formation basis and characteristic of common law system and civil law system.We can get the required information through literature review,and investigate the data of legal profession based on judicial practice in China in recent years.First of all,this paper makes an overview of the legal professional community,which shows that the scope of the legal professional community is different between China and foreign countries.Legal profession has existed in China since ancient times.However,the legal profession in ancient times is more political,and the scope of legal profession in modern China is wider.This paper discusses in detail the core of the community-judges,prosecutors,lawyers and legal scholars,their role orientation and development in China.The characteristics of legal profession community are different from other communities.It naturally includes the characteristics of legal profession,including autonomy,professionalism,mobility and restriction.Autonomy is the core feature,and professionalism is the key to distinguish legal profession from other professions.In recent years,China’s legal professional community has developed rapidly.This paper explains this.However,there are still many deficiencies.There are two factors restricting the construction of legal professional community in China,namely,concept and reality.The concept is mainly due to historical reasons,including the traditional pattern of difference order,class concept and lack of rational spirit.The realistic dilemma includes role conflict,lack of identity and non professionalism.The difficulties at both levels can be properly solved through efforts.The legal professional community in foreign countries has a long history.Although it has a different development process from our country,we can explore the experience of the development of legal professional community in two different legal systems,namely,the common law system and the continental law system.We can learn from them and transform them to make them suitable for China’s socialist national conditions.At present,China has the feasibility of building a legal professional community,with the strong support of the top-level design,and has the basic conditions for its formation.In the construction path of the community,we can start from the following five aspects: the innovation of legal education training mode,the improvement of the level of legal professional autonomy,the improvement of the selection and appointment system of judges and prosecutors,the enhancement of legal professional identity,the differentiation of legal profession,the reshaping of legal professional ethics.At present,China’s legal professional community is in the stage of development and transition.To achieve the construction goal,we need to create a good legal environment,which depends on the joint efforts of legal professionals and the whole society.I believe that in time,the legal professional community will be built successfully.
