Research On The Legal Regulation Of Rural Villagers’ Housing Construction

With the continuous development of China’s economy and society and the narrowing of the gap between urban and rural development,rural villagers are increasingly rich,their living standards are steadily improving,and their yearning for a better life is increasingly strong.Rural housing is the center of rural villagers’ life.Improving housing conditions and housing environment is an indispensable part for rural villagers to improve their living comfort and pursue a better life.In order to improve the living quality and living environment,the wave of rural villagers’ housing construction has been in full swing for more than ten years.However,due to the weak management of rural villagers’ housing construction and the constraints of farmers’ own conditions,there are many problems in the process of rural villagers’ housing construction,such as building without approval,building in excess of area and height,building in disorder and so on,which affect the appearance of the village and result in the waste of land resources.Under the background of vigorously implementing the strategy of Rural Revitalization and building ecological and livable beautiful countryside,it is urgent to fundamentally solve the problem of rural villagers’ housing construction,guide rural villagers to build houses orderly and improve rural living environment.Firstly,this paper defines the related concepts of rural villagers’ housing construction.The main form of rural housing construction is the self construction of rural villagers.Rural villagers participate in or hire others to design and construct houses and ancillary facilities on their own homestead.Rural villagers have great autonomy in the process of housing construction,and they are also prone to problems,which need to be reasonably regulated.At the same time,it combs the historical development of the legal system of rural villagers’ housing construction in China,and summarizes the basic institutional characteristics of "collective ownership,member use,one household,limited area,planning control" of rural villagers’ housing land and construction in China.Secondly,this paper systematically combs the relevant laws,regulations and policy documents on the regulation of rural villagers’ housing construction,introduces the current situation of rural villagers’ housing construction regulation,and seriously analyzes the problems and reasons in the regulation of rural villagers’ housing construction The construction behavior is lack of standardization.Then,this paper reviews and summarizes the regulatory experience of rural villagers’ housing construction abroad,trying to find a place for reference.Finally,on the basis of reality,combined with foreign regulatory experience,the paper puts forward some suggestions on the regulation of rural villagers’ housing construction,such as improving legislation,clarifying the subject of land use,strengthening planning control and standardizing construction behavior.
