Research On Community Correction System In China

Community correction is the product of the organic combination of government forces and social forces.It is an important system to implement the criminal policy of tempering justice with mercy and promote the modernization of national governance system and governance capacity.It is based on China’s national conditions and long-term criminal justice practical experience,and draws lessons from and absorbs the beneficial practices of other countries,The gradually developed non custodial criminal execution system with Chinese characteristics.From the practice of community correction,the community correction system has achieved long-term development in China.The promulgation and implementation of the community correction law provides a strong support for the legalization of community correction and is an important symbol of the development of China’s community correction system.It will have a positive impact on improving China’s penalty execution system,avoiding new violations and crimes,and reducing and eliminating social contradictions.However,in the process of how to implement the community correction law,there are still many areas that need to be improved and improved,such as the construction of community correction team and the participation of social forces,the improvement of information level of community correction institutions,individual education and ideological correction,and the grasp of the scale of frequent cross city and county approval of community correction objects.On the basis of referring to a large number of materials,combined with the author’s own work experience,taking the community correction system as the cut-off point,this paper deeply analyzes the existing problems,causes and effects,and puts forward some personal rationalization suggestions for promoting the healthy development of China’s community correction system.This paper is divided into five chapters.The first chapter is the introduction.This paper mainly discusses the following three aspects: first,the research background and significance of the subject;The second is the research review at home and abroad,which mainly discusses the origin and current situation of community correction system as an imported product,as well as the current situation and level of domestic research;The third is the research method,which mainly adopts the field research method,comparative research method,literature research method,case analysis method and so on.The second chapter is the exploration and practice of community correction system.It mainly discusses the following aspects: the historical evolution of China’s community correction system,the investigation of the implementation of the community correction law,and the operation mechanism of the community correction system.The third chapter is the orientation of the nature of community correction and the identity of the staff of community correction institutions.This paper mainly discusses the following aspects: the current understanding of the nature of community correction in the practical circle,the understanding of the nature of community correction in the theoretical circle,the identity attribute of the staff of community correction institutions,the relationship between the staff of community correction institutions and other correction workers,and the system of community correction officer.The fourth chapter is the problems faced by the implementation of community correction system.This paper mainly discusses that since the implementation of the community correction law on July 1,2020,through the investigation and exploration of the specific situation of community correction,it is found that there are some problems in the specific practice process,such as the examination and approval procedure of community correction objects going out frequently across cities and counties,the participation of social forces in community correction,the information construction of community correction,and the education of community correction objects.The fifth chapter is the solution and the improvement of community correction system.In view of the problems discussed in the fourth part,combined with the current situation since the implementation of China’s newly promulgated community correction law and learning from foreign experience,this paper puts forward countermeasures and suggestions to improve the community correction system from four aspects: improving the approval procedure,deepening the integration of community correction and social forces,building "intelligent correction" and strengthening the humanization of educational assistance.
