| At present,phenomena such as huge quantitative basis,fast process speed,ageing degree not matching to economic development level,etc.exists in our country1,from which,even “scissors difference between urban and rural areas”ageing as the special circumstances has appeared,that is,the severity of the rural aging population is much higher than that of urban.That the rural youth population is lost severely,there land sources are non-occupied,there the older and children as the mainly left-behind personnel and pension especially the rural pension as the issues,have become more serious and urgent2.While social pension insurance as the last security system to solve the issue of rural pension,that inadequate legal system,lack of regulatory mechanisms for insurance funds and unclear government responsibility,etc.as the historically left problems exist in itself.Supply side for rural pension is obvious insufficient,which leads as well to a great challenges to current rural pension insurance system,and whose rule of law is nothing but the needs of practice.Construction of rural pension insurance system has begun since 1980 s in our country,and the subsequent pilot of new rural pension insurance,promulgation of Social Insurance Law of the People’s Republic of China and full boosting of urban and town residents pension insurance3,a series of introductions of such measures and enforcement of laws and regulations to this has all marked that our rural social pension insurance is moving forward to the objective of rule o law.In September 2018,Strategic Plan for Rural Revitalization(2018-2022)was introduced formally,which clearly pointed out to strengthen the construction of rural social security system and enhancing rural pension capacity,which happens to meet the need of rule of law of rural pension.Meanwhile,that the old-age should be ensured for his support is also an important objective of our reform of social security system.While under the support of Rural Revitalization Strategy,such an objective above is not only for the elderly to be supported,but both the quality and and the stability of such a pension insurance system are extremely important as well,and these objectives have to be implemented no doubt by path of rule of law of rural pension insurance.Based on the above thoughts,this paper is to analyze in five parts.Part 1 is the Introduction,mainly taking the background from the seriousness of our rural pension problems and rural revitalization strategy to propose the paper studies,and then providing preliminary thoughts for paper going according to literature combing.Part 2 is the Description mainly on what kind of connections there are indeed between rural pension insurance and rural revitalization strategies,and why to be rule of law for rural pension insurance.This part is the theoretical basis and premise of the paper going.Part 3 describes practical difficulties in the process of our implementation of rule of law of rural pension insurance,which is divided into inner and outer difficulties.Part 4 is the summary of some deficiencies of our current rural pension insurance system as well as its advantages leading by our Rural Revitalization Strategy through comparison with abroad ones in legal system.Part 5 concerns about some measures of rule of law of the implementation to our rural pension insurance from legal system construction to running of pension fund by ways of legislation,enforcement and justice,etc.to impose the rule of law to every phrases of rural pension insurance.The main highlights of the studies is not to limit the concern to our rural pension insurance system itself only,but to take it a combination with rural revitalization strategy,take the practical problems considered under the huge environment how to boost rural development.Such studies will have certain theoretical and practical values no matter from specific work to push forward to our Rural Revitalization Strategy,or enforcement of rule of law of rural pension insurance. |
