A Special Study On Administrative Measures For The Protection Of Erhai Lake

Erhai Lake,located in Dali Bai Autonomous Prefecture of Yunnan Province,is the mother lake for the people of Dali Bai Autonomous Prefecture.Since the1980 s,with the development and utilization of Erhai water resource,pollutant in the lake have increased significantly,the pressure on the environment of Erhai lake has increased.Since then,in order to control the pollution of Erhai lake,the local government has implemented water administrative measures such as returning farmland to the lake,and the ecologic environment of Erhai lake has been improved to some extent.However,in recent years,with the development of these conditions,such as the burgeoning new coastal inn-style tourism industry represented by Shuanglang Town,Dali City,the over-exploitation of non-coal mines such as quarrying and sand dredging in the Erhai Lake basin,and the extensive cultivating the high water and high fertilizer crops such as garlic and so on,the pressures on the water environment of Erhai lake continues to increase.In order to further efficiently curb the pollution of the water and achieve efficient basin management and control,local government have implemented a series of administrative measures,such as closing of non-coal mines,the prohibition of breeding and the application of pesticides and fertilizers in the Erhai basin.During the implementation of such administrative measures,it reflects the relationship between the legitimacy and rationality of the administrative measures of the local government.This article is a special research report.It will surround the basic principles administrative law such as legitimacy and rationality.It focus on the summary and legal analysis of 8representative administrative measures for Erhai lake protection implemented by local government from 2017 to 2019.It also draws on the legal practices of the lake protection in foreign,and put forward reasonable opinions on the administrative measures to improve the protection of Erhai lake by local government,in order to promote the construction of ecological civilization and the harmonious development of economy and society in Dali Bai Autonomous Prefecture.
