The Development And Improvement Of The Filing Review System

The system of archival filing and examination is a legislative supervision system,an important part of constitutional supervision,and a constitutional system with Chinese characteristics.Since the 19 th national congress of the communist party of China(CPC),it has become a consensus that the rule of law is the key to the rule of law.The key to the realization of constitutional governance is to promote the work of constitutional review,and the promotion of constitutional review has become the focus of the rule of law work.As an important part of constitutional supervision,the system of record review is the key to promote the work of constitutional review.For this reason,the central committee of the party has put forward the new requirements of "necessary,ready to be examined,and mistakes to be rectified".Since the legislation law was amended in 2015,the system of filing and review has been further supplemented and improved.However,there are still some problems in the system of archival filing review,which hinder the development and improvement of the system.This paper will start from the relevant concepts of archival examination system,focus on the archival examination system problems are summarized,and try to put forward some ideas and methods to solve.This paper consists of four parts.The first part is the definition and discrimination of the relevant concepts of the filing and review system.There is no unified definition of normative documents in the academic circle,which mainly includes broad sense and narrow sense.Secondly,the record and review of the definition and discrimination.Finally,discuss the relationship between filing and review.There are two main views on the relationship between archival filing and review in academic circles.Second,the record will inevitably lead to review.The second part is to comb the historical process of the formation,establishment and improvement of the archival filing review system,showing the relevant contents of the archival filing review system in each historical stage.The third part is to put forward the problems of the system of record review.At present,the main problems of archival filing review system lie in five aspects: archival filing review subject,initiation of review mechanism,right of archival filing review,responsibility mechanism and public participation mechanism.As to these five aspects of the problem,this paper will carry out a detailed discussion.The fourth part puts forward some ideas and methods to solve the five problems,and discusses the feasibility and necessity of these ideas and methods from theory and practice.
