The Grassroots Courts Participate In The Research On Social Governance Issues And Countermeasures

In the recent period,with the continuous growth of China's economy,China's social structure facing with tremendous changes,and people's interest demands have become increasingly diverse,leading to the accumulation of conflicts in real life,which poses threat to the maintenance of social harmony and stability.The Fourth Plenary Session of the 18 th CPC Central Committee put forward about "improving the mechanism for resolving social contradictions and disputes and improving the mechanism for resolving diverse disputes".From the Fourth Plenary Session of the 18 th CPC Central Committee's request to "improve the resolution mechanism of social contradictions and disputes and improve the diversified dispute resolution mechanism",to the report of the 19 th National Congress' s emphasis on "the current social contradictions and problems are intertwined and superimposed,and it is necessary to create a social governance pattern which is built by all,governed by all and shared by all".so,it can be seen that our country is highly concerned about social governance and resolving contradictions.In recent years,courts and other administrative departments are carrying out localized social governance practice and innovation.Grass-roots is the gathering place of contradictions and risks,and it is also the most direct and effective field to investigate and resolve social contradictions and disputes.County-level people's courts are regarded as "displays" of social contradictions and disputes,and can actively transform their judicial functions into social governance efficiency.This paper focuses on resolving contradictions and disputes at the grass-roots level,taking J County People's Court of S Province as the researchers,and adopts two theory,which is the new public management theory and governance theory,through the analysis of the practice of court participating in social governance,this paper analyzes the practiced,finding problems and causes of its participation in social governance,in the last,this paper giving some countermeasures and suggestions,in order to improve the participation of grass-roots courts in social governance.At first,this paper introduces the basic concepts of court,social governance,multi-element dispute resolution mechanism,then point out the grass-roots courts should prevent and resolve social conflicts as the starting point.Secondly,the paper analyzes the reasons why the grass-roots courts participate in social governance,and points out that the grass-roots courts are active participants and strong guarantors of social governance activities.The basic court explored and formed the ways to participate in social governance activities,including carrying out multiple disputes resolution,judicial propaganda and judicial suggestions.However,we can also find many problems,such as the lack of awareness of the main responsibility;the lack of interaction of multiple dispute resolution resources;the lack of "grasping the front-end and preventing disease" the lack of judicial knowledge reserve to respond to the needs of governance in a timely and effective manner.The reason of these problems as follows: first,the direction of governance practice is vague,the pressure of case trial and assessment is great;second,the solution of contradiction disputes lacks joint adjustment linkage mechanism;thirdly,the basic level has the characteristics of "Acquaintances Society".According to the above problems and causes,the paper figure out countermeasures and suggestions : first,"party building leading+trial" :accurately positioning the direction of resolving conflicts and disputes;second,"resource interaction+trial" : promoting the formation of a joint force to resolve conflicts and disputes;third,"mainstream value+trial" :let the grassroots society respect the law and be virtuous.
