Research On Consumer Rights Protection Of Single-purpose Commercial Prepaid Cards

With the continuous development of technology,people has been addicted to live a convenient and fast life gradually in recent years,and the consumption model of single-purpose commercial prepaid card has come into existence.The continuous expansion of consumers' demands and the diversification of competitive methods have led to the rapid development of prepaid card consumption.Also,the scope of application scenario has become wider and wider.However,the problems behind the usage of prepaid card has been exposed while it keeps stimulating consumption and accelerating economic development.Exaggerated publicity,false promises,shrinking services,unfair clauses and other phenomena are commonplace.Consumer rights are frequently violated.Meanwhile,the weak judicial remedies and regulatory confusion have put the consumer rights and interests of single-purpose prepaid card not been effectively protected,causing a large number of consumers to become skeptical of commercial prepaid card.Therefore,it is necessary to identify the issues related to the consumption of single-purpose commercial prepaid card and to improve the protection system for consumer rights of single-purpose prepaid card.This paper takes the protection of consumer rights and interests in single-purpose prepaid business card consumption as an entry point,combined with relevant theoretical research and beneficial experience at home and abroad,trying to provide targeted suggestions on the improvement of my country's single-purpose commercial prepaid card consumer rights protection system.In addition to the introductory part,this article is divided into the following four parts:The first part is a basic overview of single-purpose commercial prepaid card consumption,which clarifies the definition and characteristics of single-purpose commercial prepaid card,analyzes its pros and cons.Based on that,the analysis of the legal nature demonstrates that a single-purpose prepaid card consumption contract is actually a new type of consumption contract,which is unique compared with the general commodity sales contract,laying a basic theoretical foundation for the following study of the consumer rights protection system in prepaid card consumption.The second part mainly discusses the current situation of consumer protection of single-purpose commercial prepaid card.In the field of single-purpose commercial prepaid card,merchants' false propaganda,shrinking services,abuse of format clauses,and absconding with money are common occurrences.These actual consumer disputes reflect that consumers' right to know the truth,right to fair transactions,right to self-choice,and right to safety was gravely violated.This section points out the actual problems through the specific analysis of judicial cases.The third part analyzes the causes of the dilemma of consumer rights protection for single-purpose commercial prepaid card on the basis of the second part.Although my country provides legal protection for consumers from multiple levels of civil and administrative aspects.Nonetheless,imperfect laws and regulations,chaotic administrative supervision,the lack of integrity of operators and the difficulty of protecting consumers' rights have highlighted the unsound of my country's single-purpose commercial prepaid card consumer rights protection system.Perfect legal regulation is urgently needed.The fourth part combines the issues raised above and the investigation of relevant systems in foreign countries and Taiwan,aiming at the frequent infringement of consumer rights and interests of single-purpose commercial prepaid card,proposes suggestions to improve the protection system of consumer rights and interests of single-purpose commercial prepaid card in my country.By improving the current relevant legislation and regulations,establishing a social protection system to protect the rights and interests of prepaid card,and strengthening the supervision of prepaid card consumption patterns,the rights of the card-holder consumers will be fully protected.
