Research On The Legal System Of Practice Rights Protection Of Vocational School Students From The Perspective Of Industry Education Integration

From the combination of work and study to school enterprise cooperation,and then to the integration of production and education,is an important symbol of the deepening of the national vocational education reform and development.Vocational school students have a special dominant position in the integration of production and education.At present,the lack of protection of vocational school students’ internship rights is prominent,which has become an important obstacle to the promotion of the integration of industry and education.The main performance is that the relevant enterprises and industry associations lack sufficient support for students’ internship,the legal relationship between students and internship enterprises is unclear,all walks of life do not pay enough attention to the protection of students’ internship labor rights,the attribution of students’ internship achievements is unclear,and the relief of students’ internship related labor rights is difficult,etc.In order to systematically solve the problem of lack of protection of vocational school students’ internship rights from the perspective of legal theory and system,we should deepen the relevant theoretical research under the theoretical guidance of Marxist law,and build a perfect legal system for the protection of vocational school students’ internship Rights: first,we should improve the relevant legal system for the identification and incentive of industry education integration enterprises,We should stimulate the enthusiasm of enterprises to participate in the integration of industry and education,broaden the ability range of enterprises and industry associations in the integration of industry and education,and effectively solve the problem of insufficient supply of internship posts for vocational school students.Second,we should make it clear that vocational school students’ internship behavior has the dual special attributes of education and labor in the legal system.We should adopt quasi labor relationship to reduce and complete the pressure of the lack of labor legal system related to the protection of students’ internship rights,improve the legal provisions of students’ participation in internship activities,and protect students’ internship rights by labor contract in the perspective of labor law.Third,we should categorize the current situation of the damage of students’ internship labor rights,bring it into the legal system of labor rights relief,apply the industrial injury insurance system,and strengthen the protection of students’ internship labor rights.Fourth,we should strengthen the protection of students’ inventions and creations during their internship,make it clear that most of them belong to "job-related achievements",and protect students’ rights to sign and get remuneration for such "job-related achievements".Fifthly,we should construct the relief system of priority right of appeal,classify the rights related to internship labor of students in the integration of industry and education,and construct the combination of school appeal system and labor appeal system according to the nature of internship disputes,the emphasis of students’ needs,and the strength differences of various relief forces of students’ rights,so as to comprehensively protect the personal and material rights of internship students,And the legitimate rights and interests of invention and creation.
