Research On Collaborative Supervision Of Maritime Traffic Safety In China

The safety of maritime traffic exists objectively with the production activities of maritime traffic and transportation.With the rapid growth of maritime transport,the risk of maritime traffic safety accidents is increasing day by day,and the pressure of maritime traffic safety supervision is prominent.Past maritime sector through a strong administrative means a single department to carry out the industry regulation mode have played a role in the past more than ten years,but not in front of the new social public situation,according to regulation of the new situation,how to provide industry and public satisfaction of maritime sector needs to become one of the research of public service.This thesis introduces the theory of collaborative governance,combined with the special situation of maritime traffic safety supervision,using literature method,induction method and comparative analysis method to explore the collaborative supervision of maritime traffic safety in China.Firstly,the status quo of cooperative supervision of maritime traffic safety in China is described from three aspects: multiple subjects of maritime traffic safety supervision,various laws and regulations of maritime traffic safety supervision,and cooperation mechanism of maritime traffic safety supervision.Based on the SFIC collaborative governance model,the thesis expounds the existing problems in the collaborative supervision of maritime traffic safety in China from four aspects: asymmetric information resources,fragmented subject,unsmooth joint law enforcement,and unsolved root causes of special regulation.According to the analysis of the above problems,the causes are the lack of effective communication and exchange between the subjects,the unclear definition of the regulatory rights and responsibilities of the multiple subjects,the lack of unified law enforcement standards for collaborative formulation,and the lack of a long-term mechanism for safety supervision.Secondly,through the analysis of the status of maritime traffic safety collaborative supervision in the United States,Japan and the United Kingdom,the relevant experience of overseas maritime traffic safety collaborative supervision focusing on the construction of professional teams,management agencies performing their own duties and focusing on collaborative linkage,and social organizations participating in safety supervision is summarized.Finally,in view of the current problem of maritime traffic safety synergy regulation in our country,on the base of draw lessons from foreign experience to propose countermeasures,such as clearly the responsibilities of multiple regulatory agencies,to perfect the law system and law enforcement cooperation mechanism,strengthen coordinated regulation of information sharing,improve the maritime traffic safety supervision long-acting mechanism together.This thesis tries to explore a new governance perspective and a systematic and scientific supervision mode of maritime traffic safety,in order to improve the efficiency of cooperative supervision of maritime traffic safety in China.
