A Report On The E-C Translation Of The Nature Of Legal Interpretation:Translation Strategies Of Parentheses

This translation practice is based on the first chapter of The Nature of Legal Interpretation written by Brian G.Slocum,a professor of law at the University of the Pacific Mc George School of Law.This book is an excellent work of jurisprudence,and the discussion of the abridged text focuses on the important role of linguistic knowledge in legal interpretation.Through the analysis of the original text,the translator finds that a large number of parentheses are frequently used.These parentheses are variable in form,position and function,helping the author to enhance the coherence of the essay,convey distinct emotions and attitude and make the argument more eloquent,while they also bring a great challenge to both the translator’s understanding and translation.From a functional perspective,the translator classifies the functions of parentheses into ideographic,rhetorical and stylistic functions.Under the guidance of the skopos theory,the translator explores different translation methods of parentheses.As a result,the translator puts forward four translation strategies for various types of parentheses,which include the strategy of placing the parenthesis at the beginning of the sentence,incorporating the parenthesis into the sentence,translating the parenthesis in the original order and using brackets to deal with parenthesis.These methods help achieve the translation purpose of accurately conveying the information of the original text.This practice is expected to raise the attention of legal interpretation in China’s jurisprudence and academia,promote the development of legal hermeneutics in China,and the translation strategies of parentheses put forward by the translator can be used as reference for translating similar texts.
