| “Wu Bamboo and Wood Slips Unearthed from Zoumalou in Changsha ”(hereinafter referred to as Wu bamboo slips)retains the direct legal materials of the Sun Wu period of the Three Kingdoms.It belongs to the first-hand materials about the Sun Wu period of legal system,due to reliable because not being circulated in later generations.The systematic sorting of Wu bamboo slips legal literature can provide important references for the study of legal history in ancient China.This article takes The First Volume Wu Bamboo and Wood Slips Unearthed from Zoumalou in Changsha to The Ninth Volume Wu Bamboo and Wood Slips Unearthed from Zoumalou in Changsha as the main research materials.By using the methods of hieroglyphs image-interpretation,two-fold evidence and the combination of horizontal comparison and vertical comparison,this study makes an exhaustive collation,and systematic study of legal literature in Wu bamboo slips.The full text is divided into four chapters,the content is as follows:The first chapter of the summary mainly expounds the research materials and research status of Wu bamboo slips’ legal literature.It also describes the research significance,ideas and methods of this paper,the composition of Wu bamboo slips’ legal literature involved in the article,the era of Wu bamboo slips’ legal literature.The second chapter is to organize Wu bamboo slips’ legal literature in the system.Wu bamboo slips’ legal literature is divided into three parts according to the content,that is,the Xu Di and Zhu Biao cut rice cases and other scattered legal documents.At the same time,the compiled Wu bamboo slips’ legal literature will be revised and annotated.The third chapter is a special study of the cut rice cases in Wu bamboo slips’ legal literature.The first is to carry out the connection of time and content in Xu Di cut rice case and restore the dynamic process from start to finish.The second is based on the dynamic process to solve the problem of the number of salt and rice involved in the Xu Di cut rice case and inspect Sun Wu’s legislation and criminal law.The fourth chapter based on the correction of Wu bamboo slips’ legal literature to individually extracte and analyse the word examples that worth discussing.After the text,it is the appendix,that is,the newly renovated interpretation of the Wu bamboo slips’ legal literature,which is a direct presentation of the interpretation of Wu bamboo slips’ legal literature after the amendment.For the first time in this article,this study sorts out the legal literature in Wu bamboo slips.And combined with the opinions of scholars to revise and annotate the legal literature.It can be made to maintain the true face of legal literature as much as possible.The special research on legal literature in this article helps us to better understand the legal system of the litigation system,trial system,and punishment system of Sun Wu’s period.For example,through the connection with time and content of the Xu Di cut rice case,it is beneficial to grasp the Xu Di case as a whole and restore the operation process of Sun Wu’s judicial work.The facts of Xu Di sale of salt and rice reflect the Sun Wu carefully detected Xu Di’s falsehood.Through the study of the legal form of Wu bamboo slips,inferred subjects were liked by the ruler because of flexibility and practicality in the legal system of Sun Wu and should be a pivotal position.Through the consideration of punishment that appeared in Wu bamboo slips,it was not found that "Strangling","Before beheading with the burnt red saw" and "Splitting with a knife" to use as brutal punishments.It reflects Sun Wu’s rational legal characteristics.In terms of vocabulary,the comprehensive collation and research of Wu bamboo slips’ legal literature materials are conducive to in-depth understanding of the characteristics about Wu bamboo slips’ vocabulary.It is also has great significance to study the history of Chinese vocabulary and the history of ancient Chinese legal language. |
