On The Right To Decide Major Matters Of Local People’s Congresses

Local people’s congresses at or above the county level and their standing committees have the power to discuss and decide on major issues and projects in their respective administrative areas.As major local issues,it covers a series of major issues and projects directly related to citizens’ rights,people’s well-being,social stability and national development in the administrative Region,including politics,economy,culture,science and technology,ecological environment,natural resources,ethnic groups and religions.As one of the basic functions and powers of local people’s congress and its standing committee,for a long time,its connotation and denotation indistinct definition exists,applicable problem crossing with other functions and powers as the place National People’s Congress,and the decision-making power of class party committee,the government enforcement of parallel problem has not been consensus in theory,in practice also lead to place National People’s Congress generally fails to perform the functions and powers.In 2022,the NPC revised the Local Organization Law,expanding the scope and authority of decisions on major issues and projects of local people’s congresses,but also bringing new problems of power conflicts between state organs at different levels and departments.This paper focuses on sorting out the basic concepts in the theoretical research of the right to decide major matters of local people’s congresses,investigating the historical origin and development status of the right to decide major matters,and copying the basic legal theory picture of the right to decide major matters.This paper analyzes the existing achievements,problems and shortcomings through a horizontal study of the practice of local people’s congresses exercising the right to decide major issues;This paper analyzes the internal and external relations of the right to decide major matters,and constructs the practice pattern of the local people’s congress exercising the right to decide major matters.This paper analyzes the current situation and causes of the decision-making power system of major matters of local people’s congresses and points out the shortcomings of the corresponding functions of decision-making power and the process of exercising power.This paper synthesizes the theory and practical dilemma of the local people’s congress ’right to decide major matters,proposes to standardize and expend the power boundary,optimize the process of exercising power by legislation,strengthen the organizational construction of the local people’s Congress,and puts forward the optimization path for the optimization of the system of the local people’s Congress’ right to decide major matters.
