Transnational crime police cooperation refers to the law enforcement actions that are carried out by countries or regions in order to combat transnational crimes and maintain the international order and the security and stability of countries and regions.Specifically,the authorized police agency,that is,the police agency,is a public authority that assists and cooperates with each other in punishing and preventing transnational crimes based on conventions,agreements and national laws.Transnational criminal police cooperation covers part of the connotation of criminal judicial cooperation.The characteristics of transnational criminal police cooperation include sovereignty,equality and reciprocity,dual legality and flexibility of cooperation legal basis.It is of great significance to carry out transnational crime police cooperation with ASEAN countries in China: it can provide a good legal environment for deepening economic and trade cooperation between the two sides;It is a realistic need to combat transnational crimes;It is a powerful complement to international judicial assistance.Based on the sound political and legal foundation,China and ASEAN countries carry out various forms of transnational criminal police cooperation: dispatching overseas police liaison officers,joint operations,joint investigations,joint arrests,joint trials,training cooperation of police cooperation talents,sharing of criminal information and intelligence networks and development of high-tech police assistance,border inspection prevention mechanism and other cooperation mechanisms.With the continuous development of transnational crime police cooperation between China and ASEAN countries,many influential transnational crime police cooperation have emerged.Effectively cracked down on and prevented transnational crimes,and improved the law enforcement level of police agencies in various countries.However,there are some problems in transnational crime police cooperation between China and ASEAN countries.At the political level,the principle of national sovereignty affects the comprehensive development of transnational crime police cooperation between China and ASEAN countries.The rising trend of anti-globalization brings challenges to the deepening of transnational crime police cooperation between the two sides.At the legal level,the international legal basis of police cooperation is too abstract and not operational;China’s domestic law on police cooperation in transnational crimes with ASEAN countries needs to be improved.At the administrative mechanism level,there is a lack of a standing organization with a complete organizational framework;No data platform covering criminal information and intelligence sharing between China and ASEAN countries has been established;No effective training mechanism for transnational crime police cooperation talents has been established;Lack of a unified arrest mechanism for transnational criminals.In the view of the problems,the cooperation between China and ASEAN countries in transnational crime policing can be improved from three aspects.At the political level,the perfect path includes strengthening economic cooperation between the two sides,promoting political mutual trust and consolidating the political foundation of transnational crime police cooperation between the two sides;Strengthen the counterpart support of transnational crime police cooperation,and enhance the political mutual cooperation between the two sides in transnational crime police cooperation.Adhere to equality and reciprocity to reduce the influence of sovereignty principle on transnational crime police cooperation.At the legal level,the domestic legislation of bilateral treaties and international treaties between China and ASEAN countries should be strengthened;To formulate supporting rules for the signing of relevant co-operation documents;Formulate the Police Cooperation Law of the People’s Republic of China.At the administrative mechanism level,a unified permanent institution of transnational crime police cooperation between China and ASEAN countries should be established;Establish a transnational crime database and communication platform between China and ASEAN countries;A unified arrest warrant system should be established;Establish a talent training mechanism for transnational crime police cooperation between China and ASEAN countries.
