The juvenile delinquency community correction system is a system with rigorous logic and strict form.It builds a community correction for juvenile delinquency that conforms to the requirements of the times,the world trend of lenient punishment for juvenile delinquency,and the principle of adapting punishment to crime.system is of great significance to our country.Looking at the implementation of the community correction system for juvenile delinquency in the world,due to differences in politics,economy,culture and other aspects of each country,its applicable conditions and scope are also different.In my country,the community corrections system for juvenile delinquency has gone through a process from scratch,from local pilot to national application,from non-standardization to system exploration and then to standardization,forming the distinctive features of a socialist rule of law system with Chinese characteristics.The national conditions are beneficial to the implementation of community corrections for juvenile delinquency in my country in the future.In my country,Chapter VII of the Community Corrections Law and Article 55 of the Measures for the Implementation of Community Corrections provide for the community corrections system for juvenile delinquency.The subject of correction,correction system,supervision system,support and cooperation are stipulated.These contents construct the framework of the community corrections system for juveniles in my country,and are of great significance for improving the community corrections for juvenile delinquency.At present,my country has established a relatively complete community corrections system for juveniles,which has played a positive role in preventing and reducing juvenile crime cases.However,there are many situations that may exist in legislation,the macro nature of legal provisions is not clear,and the protection of minor community corrections subjects in the non-compulsory education stage is relatively low.Juvenile delinquency correction work within the jurisdiction.Research on the problem of community correction system for juvenile delinquency.The first part mainly takes the development of my country’s social correction system as the starting point,and analyzes the process of my country’s community correction system from trial implementation to legislation since 2003.At the same time,the deficiencies in the development process were sorted out.The second part takes the United States,the United Kingdom,Germany,and Japan as the research objects,and considers the experience that can be referred to in terms of legislation and judicial guidance,and how to complete the legislation for juvenile delinquency.The third part analyzes issues such as the procuratorial supervision of juvenile delinquency community correction work,the fragmented legal system for juvenile protection,the scope of applicable objects of juvenile community correction,and the lack of judicial procedures,and finds out the implementation process of juvenile crime community correction in my country.The crux of the problem,and the reasons for the existence of the problem are analyzed,in order to better propose a rational approach.In the last part,by summarizing the previous experience outside the territory and analyzing the current problems in our country,the following points of improvement are put forward: First,improve the procuratorial supervision system for community correction of minors,and use a more complete procuratorial supervision as the juvenile.The protection in the process of community corrections,so as to protect the legitimate rights and interests of minors in the whole process of correction;the second is to build a professional team for the implementation of juvenile delinquency community corrections,so as to achieve the effect of correction and get twice the result with half the effort;the third is to improve the assessment and evaluation of corrections for minors System and education correction measures,only by providing real assistance to minors for correction,can they truly achieve the purpose of correcting minors;the fourth is to share information on minors and joint law enforcement,use technology and transformation Combining them,we can help the reformed objects more accurately;finally,by improving the relevant legislation and refining the extensive provisions,we will try our best to prevent juvenile criminals from entering prison to serve their sentences,and give them opportunities for self-confidence in reformation.
