The report of the 20 th Party Congress pointed out that "we should promote the diversified settlement of social conflicts and disputes,enhance the rule of law in social governance,and nip disputes in the bud".With the deepening reform of socialist market economy,China’s economy is developing rapidly,and the number of enterprises and the demand for labor force are increasing.Labor relations are also becoming more and more complicated,resulting in an obvious increase of internal conflicts in labor relations,and friction between labor and management happens from time to time.Especially in the context of the transformation of the old and new dynamics,a large number of traditional high energy-consuming and labor-intensive enterprises such as coal,iron and steel are facing urgent transformation,and a large number of traditional manufacturing workers are facing the problem of re-employment choice,and the frequency of labor disputes has increased significantly.As an important judicial institution to deal with labor disputes,labor arbitration institutions,when faced with an increasing number of labor disputes,have shown a lack of ability to deal with sudden and collective labor disputes and low efficiency of arbitration.The article takes exploring how to improve the labor arbitration institution’s ability to solve and handle labor disputes under the special background of the transformation of new and old dynamic energy as the research direction.Using interview method and questionnaire survey method to collect relevant data,the article conducts in-depth research and analysis on the outstanding problems faced by labor arbitration institutions in Z county of J city under the background of the transformation of new and old dynamic energy,taking the theory of collaborative governance and polycentric governance theory as the theoretical basis and starting from the actual situation,it is concluded through data analysis that labor arbitration in Z county of J city has poor inter-departmental cooperation,increased difficulty in handling cases,labor arbitration institution setting The problems of ambiguity,low level of construction of arbitrators,and insufficient investment in hardware facilities.The main reasons for this are the inadequate coordination and linkage mechanism,the lack of response ability in the face of the new and old dynamic energy transformation,the unclear positioning of the responsibilities of labor arbitration institutions and the backward management of personnel.The article proposes countermeasures to solve the above problems,i.e.,establishing a coordination mechanism for multiple subjects to deal with labor disputes,improving the construction of grassroots mediation organizations,and guaranteeing the independence of labor arbitration,based on the background of the transformation of new and old dynamic energy in S province and taking the labor arbitration institution in Z county as the starting point.The article discusses improving the efficiency of labor arbitration institutions in handling cases and establishing a collaborative linkage mechanism between labor arbitration institutions and relevant government departments,enterprises,labor unions,and employee representatives,so as to contribute to maintaining the harmonious development of regional labor relations.It also provides reference meaning for other counties and districts that are also in the context of the transformation of new and old energy to handle labor dispute cases.
