Study On The Legislative Guarantee Of Chinese Sovereign Security In Cyberspace

The concept of state sovereignty has evolved in line with historical development and social changes.In the process of increasing the level of productivity of human society,the connotation of national sovereignty has become increasingly rich.Sovereignty began with continental sovereignty,and advances in transport and technology enabled human activity to reach further and further afield,gradually expanding to include maritime.air and space rights.The third technological revolution began in the 1970s.extending the scope of human activity to virtual cyberspace.The issue of cyberspace sovereignty has an extremely important position in cyberspace.In the face of the acts of certain cyber hegemonic countries that violate the cyber sovereignty of other countries,it is important to conduct research on the issue of "cyberspace sovereignty and security" to safeguard China’s cyberspace sovereignty and national security.Among a series of rule of law safeguards for sovereign security in cyberspace,legislative safeguards have a fundamental position and are the cornerstone of judicial safeguards and law enforcement safeguards for sovereign security in cyberspace.Therefore,the study on "legislative guarantee of sovereign security in cyberspace" is of great significance to the rule of law practice.Centering on the topic of the legislative guarantee of sovereignty security in cyberspace.this paper firstly gives an overview of sovereignty in cyberspace and clarifies relevant theories and different views on sovereignty in cyberspace.Then,it discusses the protection of sovereignty security in cyberspace,compares the connection and difference of sovereignty in cyberspace,and analyzes network security risks.The legislative guarantee of sovereignty security in cyberspace can be divided into traditional sovereign territory mode and stakeholder mode according to different modes.This article analyzes the two different modes and the legal construction and protection of representative countries with different modes,and discusses the predicament of stakeholder mode,in order to provide experience reference and inspiration for guaranteeing our sovereign security in cyberspace.By upholding the principle of sovereignty in cyberspace,the article is rich in the legislative achievements of sovereignty security in cyberspace,summarizes the legal construction and institutional innovation of sovereignty security in cyberspace,analyzes the shortcomings of the legislative guarantee of sovereignty security in cyberspace and puts forward relevant suggestions so as to improve the legislative guarantee of sovereignty security in cyberspace and safeguard national sovereignty security.
