Research On Soft Law Of Cyberspace Sovereignty

Cyberspace,as a new space field,brings great convenience to people’s lives,but also causes many problems and challenges.Among them,the issue of cyberspace sovereignty is the most important.It is related to the establishment of global cyberspace system and the establishment of cyberspace governance model.At present,due to the different development levels of cyberspace in different countries,there are many differences and conflicts in the sovereignty and governance of cyberspace.The formulation of cyberspace soft law is also complicated and chaotic.Therefore,starting from the concept of cyberspace sovereignty,this paper studies the current international situation of cyberspace sovereignty and cyberspace soft law,and summarizes the problems in practice.Finally,aiming at the above problems,this paper puts forward some suggestions for China.The first chapter mainly studies the principle of sovereignty and the connotation of cyberspace sovereignty.And provide a basis for the existence of cyberspace sovereignty from the perspective of theory and practice.The second chapter mainly studies the promulgation of soft law in the international community and sovereign countries.Since no relevant international treaty has been reached,soft law has become the focus of research on cyberspace sovereignty.This paper studies the soft law achieved by different subjects respectively.The third chapter mainly discusses the problems of soft law of cyberspace sovereignty in international practice.The problem is mainly divided into three aspects,namely,the limitation of soft law,the obstacle of network hegemony and the dilemma of network governance.The fourth part mainly discusses how China should deal with the problems in the practice of soft law from the perspective of international law and domestic law,and puts forward relevant suggestions.
