| In 2021,the resurgence of the Taliban attracted attention.During its two decades in exile,the Taliban issued three versions of Layha as a course of action.With the return of the Taliban to the center of power,the organizational development of the Taliban and the practice of the social governance system during exile have left an important political legacy for the construction of the Taliban’s future Islamic state: first,the way to produce the supreme leader has been gradually determined in exile: consultations within a limited scope.Second,in the practice of governance,the Taliban tried to reconcile the contradiction between Afghan centralization and a high degree of local autonomy through the establishment of a secondary judiciary.Third,replacing tribalism with Islam,the Taliban tried to build a community on the basis of religious nationalism.However,Layha is not the only legal text for the Taliban,and there are two legal documents that must be analyzed: first,the Taliban have formulated a more mature Constitution of 2005 based on their governance experience during their first administration.Second,after the Taliban regained power,it announced that the country would be governed by parts of the 1964 Constitution of Afghanistan that did not conflict with sharia law.The 1964 Constitution represents "tolerance" and "reconciliation" in the history of Afghanistan and has extremely important symbolic significance.As a relatively mature constitution,the 2005 Constitution finally gave way to the rough Layha,mainly because the 2005 Constitution could not solve a series of practical governance problems faced by the Taliban,which represented the disillusionment of the Taliban’s original Islamic ideal.On the other hand,the 1964 Constitution of Afghanistan is a flexible strategy for the Taliban to use its historical halo to cover up its true image,which represents its speculative side.And Layha reflects the Taliban’s current thinking: trying to prove that he is capable of governing Afghanistan,but not mature;the ideal of rebuilding its Islamic state,hovering between the old ideals and Pashtun tribal politics;trying to define themselves and the Islamic state they built by rules,but falling into chaos. |
