In the new era of modernization of national governance and comprehensively promoting the rule of law,the rural revitalization strategy has constructed a new framework for rural communities to adapt to the social development in the new era.Promoting the legalization of rural communities is the path to promote the superstructure to adapt to the economic foundation.The ability of rural communities to govern by law is an important part of the country’s ability to govern by law,and is also the basis for the country’s comprehensive rule of law.Therefore,in order to achieve a comprehensive rule of law,we must improve the ability of rural communities to govern according to law and realize the rule of law in rural community governance.Therefore,in the context of comprehensively governing the country according to law,the main purpose of this study is to propose suggestions to promote the improvement of the legal governance capacity of rural communities based on the problems existing in the current legal governance capacity of rural communities in China from the objective reality and the causes of the problems.This article takes Z Village in Yunnan Province as the research object,and uses questionnaire surveys,face-to-face interviews,and case analysis methods to study the legal governance ability of rural communities from three aspects: daily affairs management ability,emergency management ability,and conflict resolution ability.There are problems with the legal governance ability of Z village.In terms of daily management ability,the autonomy ability of Z village autonomous organizations is relatively low,the legal governance ability of village cadres is weak,and the villagers’ participation in the governance of their own village affairs is insufficient;In terms of emergency management capabilities,the main body of emergency management in Z village is weak,emergency management measures neglect standardization,and emergency plans lack coordination with emergency laws;In terms of dispute resolution capabilities,the village level mediation team in Z village has not truly played a role,there is a lack of effective linkage between dispute resolution mechanisms,and the role of village regulations and agreements in dispute resolution has not been fully utilized.There are multiple factors that contribute to the problem of Z Village’s ability to govern in accordance with the law.The main reason is that the transformation of village and township authority and insufficient supply of governance entities have led to weak governance capabilities of governance entities;The domination of the rule of man thinking and the lack of legal education have led to a lack of legal cultural soil in Z village’s legal governance;The inadequate ability of the village level mediation team to mediate disputes is not in line with the development of the village,the insufficient supply of legal services,and the formalization of village regulations and agreements,which leads to the insufficient supply of legal guarantee in Z village and weakens its ability to govern according to law.In order to achieve the rule of law governance in rural communities,this study proposes to enhance the daily affairs management ability,emergency management ability,and dispute resolution ability of Z Village by strengthening the governance capacity of governance entities,standardizing community measures and mechanisms,and improving community legal supply measures.It further strengthens the legal governance ability of rural communities,promotes the transformation of Z Village’s governance methods,and promotes rural social development.
