Research On The Path Of The Legalization Reform Of The Petition System From The Perspective Of Political Systems Theory

The petition system is a useful supplement to the Socialist Democracy political system with Chinese characteristics,and an organic part of the socialist legal system with Chinese characteristics.Since the establishment of New China,the Party and government have always attached great importance to the development of petition work and the improvement of petition system.The petition system in China has distinct political and legal attributes.The legalization of the petition system is conducive to the important role of the petition system in consolidating the leadership of the Party,safeguarding people’s democracy and legal rights,promoting the construction of socialist rule of law in China,and improving national governance capabilities.Looking back at the historical context of the legalization reform of the petition system,starting from the release of the "Decision on Handling People’s Letters and Receiving People’s Visits" by the State Council(now the State Council),and taking the establishment of the People’s Republic of China,reform and opening up,and the 18 th National Congress of the Communist Party of China as the time nodes,the petition system has gone through stages of initial creation,development,and deepening.The introduction of the "Regulations on Letters and Visits Work" in the new era means that China has made great achievements in the legalization reform of the letters and visits system.However,there are also urgent problems to be solved,such as difficulties in governance of the source of letters and visits,alienation of the operation mechanism of letters and visits,difficulties in resolving accumulated cases of letters and visits,and blocked online channels for letters and visits.These issues hinder the interaction between the reform system of the petition system and other systems in the overall environment,and are a "stumbling block" in the process of legalization of the petition system.The reasons for this are as follows: firstly,the legislation on petitions lags behind,and the introduction of the new law means that petitions agencies in various regions and departments have developed supporting systems for petitions based on the old law,which requires legislative reform,abolishment,and interpretation work.Moreover,due to the inherent lag of the law and the fact that most of the provisions of the new law are principled and relatively general,it is necessary to provide detailed explanations.Secondly,for a long time,there have been misunderstandings among the subjects of petitions,including petitions,petitioning acceptance departments,and their staff,which have led to illegal and irregular behaviors such as petitions by petitions,repeated petitions,and violent interception of petitions by petitioning staff.The petition system is a part of the socialist political system with Chinese characteristics and belongs to a subsystem of the political system.From the analytical perspective of political systems theory,this paper takes "input transformation output feedback" as the analytical framework,and the political system can self continue in the interaction with other systems of the external overall environment.After internal transformation of external input,external output will affect the overall environment,and the overall environment will re input the political system through the feedback loop,and continue to cycle.The reform system of the petition system has independence,forms its own system internally,and interacts with other systems to achieve self-sustaining and continuous development.Through the analysis of the interaction between the reform system of the letter and visit system and the overall external environment through the political systems theory,the legalization reform of the letter and visit system in China in the new era needs three "safeguards",namely,to ensure that the input link of the letter and visit reform system is unblocked,the letter and visit reform system is efficiently transformed,and the letter and visit reform system is positive output.
