Resarch On Legalization Of Urban And Rural Community Governance

Urban and rural communities,as an important component of grass-roots society,are the basic units of social governance.The legalization of urban and rural community governance is the internal requirement of the construction of a law-based society and the inevitable requirement of the legalization of grassroots governance.Currently,grassroots society consists of urban communities,urban and rural communities,and rural communities.There are more studies on urban community governance by law and rural community governance by law.It is important to study urban and rural community governance for grassroots social governance.By collecting and sorting out documents,we can understand the theoretical basis of urban and rural community governance and the connotation of rule of law governance,analyze the existing governance models,and find three reasons to hinder the rule of law in urban and rural communities.Governance norms are imperfect from a macro perspective including the lack of norms,lack of scientific norms,and conflicts of norms.The middle view shows that the main position of the governance organization is inaccurate including the offside of the government,the dislocation of neighborhood committees and the absence of social organizations.Micro-perspective shows that the governance actors’ ability to govern urban and rural communities is inadequate,among which the governance actors’ ability to govern in accordance with the law and the residents’ participation ability are inadequate.Facing the three major obstacles,this paper analyzes their causes and draws three conclusions:perfecting the standard system of urban and rural community governance supported by state law,folk law and soft law,implementing the participation system of street and town governments,neighborhood committees and social organizations in urban and rural community governance,and improving the ability of governance actors to govern urban and rural communities.The research on the legalization of urban and rural community governance is conducive to the participation of multiple governance subjects in urban and rural community governance according to law,building urban and rural communities ruled by law,promoting the rule of law in grassroots governance,and accelerating the process of building a society ruled by law.
