| The value of data is constantly being tapped,and it has become an indispensable new resource in social life.The issue of data sharing and opening has also become a global topic.The role of data and traffic is becoming more and more important in today’s social business field,and the large amount of data generated and obtained by the government in its administrative work has also become an important resource for the government and affects the way the government works.The value of government data lies in the various values and conveniences brought to government work and social life through the sharing and opening of government data.Based on the study of relevant literature and materials,this paper conducts research on the topic based on the operation status of the data open sharing work of the Guiyang Municipal Government.The governments of Guizhou Province and Guiyang City have issued a series of laws and regulations as well as government regulations and regulations in the exploration of government data openness and sharing,and built a unified data collection platform and sharing and opening platform,But it still lags behind the development of big data.First of all,on the basis of consulting relevant domestic and foreign literature,this paper proposes a research outline,and investigates the leaders of the Guizhou Provincial Government Big Data Development Administration,Guiyang Innovation-Driven Development Research Institute,and Guizhou-Cloud Big Data Industry Development Co.,Ltd.with corresponding questions.By means of interviews,the legal problems and other problems discovered during the operation of the data work of the Guiyang Municipal Government are investigated.Through the investigation of the Guizhou Provincial Big Data Development Administration,we understand the collection standards of government data,the enthusiasm of data suppliers,and the operation status of the government assessment and evaluation system in the open data sharing work of the Guizhou Provincial and Guiyang Municipal Governments,as well as the problems encountered in the formulation of relevant laws and regulations.The scope of government data is unclear,the ownership of government data is unclear,and the legal measures to ensure the sharing and opening of government data are insufficient.Investigating the Guiyang Innovation-Driven Development Research Institute to understand the key points and difficulties in the drafting process of laws and regulations,as well as the interpretation and improvement suggestions of relevant experts on the current relevant laws and regulations.Secondly,through the collation of the data obtained in the survey,this paper analyzes the main problems existing in the sharing and opening of government data in Guiyang,including the vague definition of government data,unclear ownership of government data,insufficient legal measures to ensure the opening and sharing of government data,Legal issues such as the lack of connection regulations between government data sharing and opening up and personal information protection,and the lack of relief mechanisms and remedies for government data sharing and opening up,as well as problems including data catalog creation,difficulties in summarizing data,low enthusiasm of administrative agencies,and data provided by administrative agencies Not timely and complete,and other problems such as internal leakage or resale during the development and utilization of government data.Finally,this paper analyzes the main legal issues found in the survey,combines the literature and the materials obtained during the survey,summarizes the legal issues of Guiyang government data sharing and opening,and proposes to clarify the scope of government data rights and improve the ownership of government data rights,establish and improve the legal measures for the safeguard and supervision mechanism,promote the connection between government data sharing and personal information protection,improve the open relief mechanism for Guiyang government data sharing,improve the compilation of government data catalogues,unify the standards for data collection,and improve the supply of government data by administrative agencies Enthusiasm,improving the timeliness and completeness of government data supply,solutions and suggestions for improving data protection mechanism. |
