Research On The Problems And Countermeasures In The Expropriation And Compensation Of Rural Houses In Pukou District

The reform and opening up has brought about the sustained and rapid development of China’s economy and society.With the continuous acceleration of the urbanization process,urban development and construction projects,such as technical and economic high-tech zones,commercial real estate development,municipal infrastructure,road and rail transit,and old city demolition and reconstruction have gradually expanded the scale of urban construction land.In this process,the existing construction land area often can not meet the project planning,then need to collect a large amount of rural collective land to ensure the progress of the project construction,collective land houses were taken together to be demolished.As a place for the common people to settle down and live,housing is the most concerned family and personal interests of the masses.But in terms of compensation for expropriation of rural collective land,there has not yet been formed a complete legal basis as compensation for expropriation of state-owned land,which also leads to prominent contradictions in the process of expropriation of houses on rural collective land.The only relevant laws that can refer to the existing rural collective land housing expropriation are the Constitution,the Land Administration Law,the Civil Code,and the Administrative Compulsory Law.However,none of these laws have detailed implementation regulations on the expropriation of collective land and housing.At the same time,in order to smoothly advance the expropriation work,most local governments have issued implementation measures and detailed rules for the expropriation of rural collective land and houses with local characteristics.However,in the specific implementation process of the expropriation work,there are still some problems,such as the effect of policy propaganda is not obvious,the procedure of compensation is not strict,the level of compensation and resettlement efficiency is low,and the level of collection and supervision needs to be improved.Pukou District is located to the north of the Yangtze River,the main city of Nanjing.As a microcosm of urban development in eastern my country,in recent years,it has seized the advantages of multiple overlapping policies and entered the best period of historical development.The scale of rural collective land expropriation in the sub-districts of Pukou District is gradually expanding,the time is tight and the tasks are heavy,the shortcomings in the expropriation policies and procedures are gradually exposed,and the expropriation contradictions have become increasingly prominent.The general rural collective land expropriation mainly involves two aspects: land and house compensation.The rural house expropriation problem studied in this paper refers to the rural collective land expropriation involving the residential houses that farmers rely on.Through literature research,questionnaire survey and field interviews,combined with own work experience and experience,the author gradually analyzes the actual situation of rural house expropriation in Pukou District in recent years from four aspects: policy advocacy,procedure implementation,compensation and resettlement,and supervision and management.Then analyze the cause of the problem.Finally,based on the actual situation of Pukou District,some countermeasures and suggestions are put forward,such as improving the comprehensive strength of the expropriation team,further standardizing the expropriation compensation and resettlement procedures,speeding up the formulation of new rural house expropriation and compensation policies,and establishing and improving the expropriation supervision and management mechanism.Through the research of the problem,the author tries to put forward feasible and practical solutions,so as to contribute to the promotion of rural housing expropriation and urban construction in Pukou District.
