A Study On The Issue Of Corruption In The Chinese Communist Party

In the practice of controlling corruption, it has been gradually realized that institution could curb corruption efficiently as a means or method by the Communist Party of China. However, whether the practical effects of one method are ideal or not is the composite effect of its properties, states and running environment. What states and operating environment will it be can realize the unity between ideal and real as for the institution? The answer to this question constitutes this article’s logical starting point, which is also a main line through the article.The Communist Party of China has taken efforts to strengthen the Party’s honest construction since its foundation. With the deepen recognition of the corruption, the clearer thoughts of controlling corruption and the more scientific strategy, the Party further strengthens the belief that institution has some characteristics such as fundamental, overall, protracted nature and stable. It’s necessary to summarize its development process when we walk far away on the road of institutional anti-corruption, which includes both practical and theoretical. Only by continuous review, can we grasp the development direction of institutional anti-corruption.The process of institutional anti-corruption of CPC can be divided into four stages in practice. Before the founding of new China, the CPC had developed a serious of strict discipline, set up a serious of strict supervision institution, founded a set of discipline inspection system adhering to the principle of Marxist proletarian party construction theory, basing on the experience of the construction and development of political parties at home and abroad for reference. In the peiroud of local ruling, the CPS had taken preliminary exploration on how to strengthen construction of anti-corruption system. Before reforming and opening, large-scale mass movement and party rectification constitute the content of controlling corruption. Although institutional anti-corruption didn’t take the leading role, significant achievements had been obtained in anti-corruption legislation and setting up rules and regulations after the initial establishment of discipline inspection and administrative supervise system. Before the eighteenth national congress of the CPC, controlling corruption started at the point of striking crimes in the field of economy, and then formed work patterns which include cadre honest and self-discipline, handling outsize cases and important cases and correcting unhealthy tendencies in department and industry. Certain systems being from trial implementation to revision, curbing corruption being perfect, corruption punishment and prevention system had optimum development under the principle of “addressing both symptoms and root causes of corruption, enforcing comprehensive treatment, giving simultaneous stresses to punishment and prevention while giving priority to prevention”. After the eighteenth national congress of the CPC, it has realized a leap in institutional anti-corruption around comprehensive enforcing strict party discipline in strengthening supervision, strengthening the system, strengthening the public and serious punishment.As for theory, Mao Zedong’s thought on jumping out of the periodic law by democracy and strengthening People’s Democratic and Inner-Party Democracy Building is the general guideline and principle of the institutional anti-corruption theory of CPC. Deng Xiaoping’s theory that institution has some characteristics such as fundamental, overall, protracted nature and stable and thought on taking a new road to rely on the system rather than the movement in party’s building, which deepens the institutional anti-corruption theory guided by general principles. If institutional anti-corruption theory in Mao Zedong thought and Deng Xiaoping Theory lays stress on macroscopic architecture and top-level design,t he latter lays emphasis on concrete operation and execution. Jiang Zemin’s thought that anti-corruption should depend on education and should lay great stress on legal system and thought that anti-corruption should follow the principle of addressing both symptoms and root causes of corruption, enforcing comprehensive treatment is the enrichment and development of the institutional anti-corruption theory of CPC from the aspect of operation, which is on the basis of deepening the recognition of corruption. The thought “addressing both symptoms and root causes of corruption, enforcing comprehensive treatment, giving simultaneous stresses to punishment and prevention while giving priority to prevention” and the idea “construct the system of scientific contents, strict procedure and complete arrangements” in Scientific development view, which signifies the upgrade of institutional anti-corruption theory of CPC.X i Jinping’s thought that “to put the power into the cage of regulation” and “put the discipline and the rules in the front” in comprehensive enforcing strict party discipline, which indicates that the institutional anti-corruption theory of CPC is more concerned about the root.How to evaluate the effect of institutional anti-corruption of the CPC? The article considers that it can be evaluated from the two angles of quality and quantity. Evaluation on the quality studies the basic running situation of system of controlling corruption by analyzing the concrete provisions, which is the direct evaluation of the system of controlling corruption. Evaluation on quantity studies the gross situation of anti-corruption by comprehensive analysis of related data promulgated by the People Court, the People’s Procuratorate and Ministry of Discipline Supervision, then judges approximate effects, which is the indirect evaluation of the operation efficiency of the system of controlling corruption, which is on the basis that the magnitude of the effects of anti-corruption can be mirrored in the level of the degree of corruption. The article draws a conclusion that anti-corruption fight is in the phase of strategic stalemate currently based on a comprehensive analysis.The effective operation of the institutional anti-corruption of CPC results from the multiple action of several factors. The institution posseses several characteristics such as scientific contents, strict procedure and complete arrangements, which makes enhancing efficiency of institutional anti-corruption possible. So we should promote institution construction following the principles of “to run the state well, we must run the Party well first; to run the Party well, we must be strict with the Party members; to be strict with the Party members, we must establish the complete system and the system must be perfect”. However, whether the possibility transfers to the reality depends on the running environment of the system. The effects of institutional anti-corruption increases when beneficial running environment exists, conversely, It decreases. The power structure and the running environment of inspecting discipline for inner-Party are more important in the several running environment of the system. The former aims at constructing the power structure and the operating mechanism which demands decision-making authority, executive power and supervisory authority are on mutual restriction and mutual coordination. The latter lays stress on the concretization of realizing the dual leadership system of Inspecting Discipline. Punishment and management are the two main forms of institutional anti-corruption. No matter what kind of forms has a certain defect inevitably and produces a certain negative effects. In view of this, institutional anti-corruption and moral education should be combined to enhance the effects of institutional anti-corruption.
