The global rise of emerging economies, the world economy and politics,profound changes have taken place.Developed countries have to stimulate the global production and consumption is no longer the only source of future rising developing countries should work together to change the global political and trade situation.As a typical representative in emerging economies, China development momentum.But the development of mineral resources consumption rose sharply, commodity markets around the world, the change of mining investment environment and the mining structure adjustment, this a series of changes will have profound impact to our country mining, is becoming more and more high to the requirement of Chinese mineral resources management.Mining administration management is the core of mining right management.State ownership of mineral resources of identity, through the mining right management,implement the basic requirement of national ownership of mineral resources.China’s mining right management has always been the government management as the main body, at different times, the government’s orientation is different.The focus of mining right management is to study the layout of mining right.So far the domestic large mining right of literature also involved, but the vast majority of all is the study of mining right, mineral exploration right and mining right, mining right legislation, the nature of mining right management specification file, the mining right system reform, mining right evaluation, and the mining right market in our country, and the literature of mining right layout is few and far between.Yet for mining right how to reasonable layout, how to carry out scientific partition, how to mining right scientific quantitative, such research is not much of the problem.In this paper, starting from the mining right legal system, the reference case and quantitative analysis, has made a scientific research to mining right layout, formed the theoretical system of mining right layout.First of all, this paper demonstrates the Chinese mineral resources legal system,including the constitution layer, laws, regulations and rules, and associated with the mining right management system are analysed in detail, analyzes the achievements and disadvantages of each.In recent years, the second, this paper adopts the system of mining right setting scheme, to seize the most important part of China’s mining right management, mining right layout- were analyzed, and combined with typical cases encountered in the practical work, to systematically study of mining right layout, main problems of mining right layout can be divided into three categories and ten small classes, and analyzes on the causes of each kind of question, put forward a reasonable solution.Later on these layout problems in integration mode, and summarizes the basic principles of mining right is set and the system of mining right setting scheme of mining right layout optimization function.Again, the thesis study of mining right layout model, the general abstract miningarea into a simple mining area layout model(ML) model, and defines the three important coefficient in the model, resource potential coefficient of DR, mining exploration degree coefficient DE, mining right distribution coefficient of DL, for these three coefficient was calculated and the nature of the discussion.Mining right layout theorem and its corollary is put forward, the last section demonstrates the development of the blank area on the influence of mining right layout.Finally, make a preliminary study of the mining right layout model in this paper,on the basis of using analogy method, analogy reserves classification of classical model, establish the model of mining right layout(REL) model, and according to the model, the mining area can be divided into eight types, then combined with the characteristics of the mining area of each type of mine administration management work center of gravity to discuss next.
