A Study On Strategy Of Technical Barriers To Trade About Agricultural Export

Since 1970s, the appreciation of living quality and"green civilization"have become more and more popular with the improvement of scientific techniques and life condition in the developed countries and regions. The need of health hazard-free agricultural products is increasing. The growing attention towards quality security of agricultural products leads to ascending ratio of related international trade on the whole trade market. To ensure the security of product quality, technical standards ,as well as product quality security certification system have been made by many countries. Therefore, the problem of technical barriers to trade (TBT) greatly influence the international trade of agricultural products. Since 1990s, especially after becoming a member of World Trade Organization(WTO), China's agricultural export has been more and more restricted by the TBT, which has become the biggest obstacle of international trade. Based on this context, the aim of this article is to offer advice and suggestions to break the TBT difficulties for China's agricultural exports, via systematic investigation of the related issues of TBT.This article reviewed the literature related to TBT(including agricultural products), generally analyzed the TBT of agricultural products, introduce the situations of TBT of international organizations and major developed countries and regions, summarized limitation of China's agricultural exports due to TBT, focus on the reasons of these restrictions, furthermore, explore China's agricultural exports strategy dealing with TBT.The main point and conclusions of this article are the following:1,Based on the review, the main difference of domestic and foreign research is the method .The foreign ones used more quantitative methods, meanwhile qualitative methods are widely used in domestic research. There is obviously a gap between them. In term of the content of the researchs, the rareness of micro-level research and strongly operational proposal of breaking the TBT for agricultural exports is relatively a weak point. The rareness pointed out a clear direction of effect for this article.2,The conception of agricultural products used in this article is not the usual sense of agricultural products (the primary products from agricultural activities, which are the plants, animals, microbes and their products according to"The Law of Agricultural Products Quality Security"), but the more used conception during the practice international trade, namely"products of foodstuffs and agriculture". In another word, this is a broad conception of agricultural products.3,Considering a number of researchs, Technical Barriers to Trade of agricultural products (TBTAP) is defined as regulations or voluntaty technical trade protection measures to maintain basic security, to ensure the human health and safety, to protect the environment and prevent fraud, and to ensure the quality of agricultural products by a country, region, regional organizations or non-governmental organization. These measures may cause negative impact on free access to the regional market for other countries and regions.This research suggested that the main characteristics of TBT of agricultural products are the following three: controversy(including legitimacy, legality, discrimination and invisibility), flexibility and harshness.4,The influence of TBT on agricultural exports in discussed in term of short, medium and long period. In short and medium term, TBT of exports mainly has negative impacts, exports decline in short term and the increase in costs in medium term because of the uncompletion of technological innovation and improvements of production and management. The impacts in long term could be negative or positive, depending on the circumstance. It requires certain conditions to transfer negative to positive.5,The same flaw of WTO"Agreement on Technical Barriers to Trade (TBT Agreement)"and"Agreement on the Application of Sanitary and Phytosanitary Measures(SPS Agreement)"is the ambiguity of some key provisions, resulting in the lack of binding, which caused the long-term suffering of injustice of China's agricultural exports. Laws always lags behind reality, and sometimes it is just a simple reflection of the reality. WTO rules are the results of negotiation of powerful countries. Under the circumstance of barriers-setting up, the weakening of legal binding is inevitable. The solution to this problem is for more than a new round of multilateral trade negotiations (for example: Doha Round), but the improvements of ability of international negotiatiions.6,There are much greater similarity than differences of agricultural products TBT of Japan, Europe Union(EU), U.S. and South Korea. The common characteristics are: A. the agricultural products quality and security management systems of the developed countries and regions share that all departments have clear devision of labor and also harmonious cooperation, and more importantly the full share of informations and the consistency of pace and sound; B. numberous of technical regulations and standards; C. the development from scattered quality standards to systemic, mandatory and standardized legal system of quality standard; D. the recognizations from more members of the whole conception of food security control, requiring more stringent technical standard; E. complicated and expensive inspection procedures; F. the promotion of beginning of setting up and usage of quality standardized measures to regulate agricultural products trade for the developing countries.7,Four main characterics of restrict of China's agricultural products exports against TBT is summarize after systemic analysis of the situations of China's agricultural products in major export markets and the major agricultural products limited by the TBT, which are: A. more and more areas damaged by TBT; B. the same reasons of failure of breaking TBT despite a great number of implementation of China's TBT is non-compliance of inspection and quarantine; C. some agricultural exports to China to implement technical barriers to trade, it is easy to spread to other export markets, forming a chain reaction, that is, a significant diffusion effect; D. on the implementation of China's agricultural exports have become more stringent technical barriers to trade trends.8,Although China's agricultural products subject to technical barriers to trade with foreign reasons, but external factors can not be changed, so the key is internal. Internal factors, the quality and safety is the fundamental reason for the low level. However, only low levels of quality and safety of agricultural products caused by China's agricultural exports face technical barriers to trade restrictions cause. In other words, the low level of quality and safety of agricultural products is caused by the many other reasons, but they reflect is the deeper problem of agriculture in China. These include: agricultural production and weak technological base; agricultural management system and management deficiencies; protection of agricultural products quality and safety regulations and standards system is not perfect; agricultural product quality testing and certification system lagged behind; not yet formed a coordinated and efficient administrative management system; trade association of agricultural products quality safety management failed to play its full part; agricultural producers, especially agricultural exports reputation mechanism is not perfect, especially the weak brand awareness. For reasons other than quality and safety are: product structure and market structure are quite reasonable; International Rules is not enough, disputes the respondent is not strong enough.9,Improve the quality and safety, respectively, and from the other two put forward China's agricultural exports break through technical barriers to trade restrictions strategy. In improving the quality and safety of this fundamental strategy, key initiatives are: to improve agricultural technology and improved agricultural standardization system; vigorously implement the industrialization of agriculture, increase the level of farmers and agricultural organizations, the degree of the scale; a sound and comprehensive system of agricultural product quality safety supervision ; sound perfect authentication system, efforts to guide enterprises in obtaining certifications; a sound and comprehensive system of inspection and quarantine of agricultural products. Deal with technical barriers to trade of agricultural products and other strategies are: to strengthen technical trade barriers for agricultural products of learning and research; a sound and comprehensive information system technical barriers to trade of agricultural products; to develop agricultural trade associations, its full technical barriers to trade in agricultural products in response to the unique effect; actively adjust the export structure of agricultural products to avoid and reduce technical barriers to trade with a variety of head-on collision.
