The Research On The Impact Of Variety Protection Institution On The Agricultural Development In China

Our country has entered in WTO, which means that practices related with seedling sector must compliance with "Agreement on Trade-Related Aspects of Intellectual Property Rights"(TRIPs). In 1970, the International Union for the Protection of New Varieties of Plants(UPOV) established "the Act for the Protection of New Varieties of Plant" that provides a protection framework of intellectual property rights for practices in varieties innovation of breeder. The Act was the earliest international plant intellectual property protection act, and where amendment in 1978 and 1991 had profound affect. China entered in UPOV on 23rd April, 1999 and the UPOV78 was the chief source of our "Protection of New Varieties of Plant". In the present, taking variety rights protection as a core, our country has preliminarily formed a set of agricultural intellectual property protection system whose legislation resource was mainly from written laws of continental laws of Europe. And our country try to establish a set of law protection system to guarantee breeding investors benefits in order to accumulate capital for further research and development and promote healthy development of plant breeding sector. In next years our country will enter UPOV 1991, so it is important on reality to research presented variety protection institution and analyze gains and losses of entry in UPOV1991. Moreover, it is significant effectiveness on boost production of agriculture and augmenting income of farmers to study variety protection institution how to solve "three rural issues", encourage constant innovation of breeding technology and accomplish effective allocation of breeding resources in the context of association variety protection with agricultural development.In the foreign, there are some researches and fruits about effects of variety protection institution on economy. But in our country implementation of variety protection is less 7 years and is absent enough observed data of time series to evaluate effect of variety protection institution on agricultural development. On the same time we have not enough official statistics data and domestic literatures to adopt. Based on economics analysis, this paper tries to discuss effect of present variety protection institution on agricultural development and possible strategies adopted. Wherefore, this thesis put emphasis on incentive system of variety protection on breeders, optimization mechanism of breeding investment and increasing fanner's income.
