Research On The China's Non-Tariff Barriers Under The Multinational Trading System

The Non-tariff barriers have already appeared in the initial stage of the capitalism, but it wasn't established extensively until 30's in 20th centuries. Since the mid 70's in 20th centuries, with the impact of the economic crisis in the world, the trade protectionism in the world scope has becoming current again. The multilateral trade negotiations, which were organized in the General Agreement on Tariffs and Trade(GATT), has made the overall level of the customs duties descended successfully, at the mean time, the key point of trade barriers shifted accordingly from customs barriers into the non-tariff barriers. As the system on multilateral trade, both the GATT and WTO are aimed to trade liberalization, but it has realized that the free trade state can't achieve absolution in the no costoms and non-tariff restriction situation. This is the reason that the second-best trade policy was taken, which also made the non-tariff barriers became necessary and legal in a long-term.With China entering the WTO, the Chinese foreign trade has witnessed a high-speed. As the third largest trade country in the world, the trade friction will inevitable become unavoidable. Being in the economic transformation period, both the structure and order about the export commodities should be improved in China. Adding to the complicated political and economical factors in the world, the non-tariff barriers will obstruct the development of the export trade over a long period. Therefore, it is very important to study this issue, no matter for the theory or the reality value.The paper introduced the related concepts, forms and the main characteristics on the non-tariff barriers, it clarified the concept on non-tariff barriers firstly, and analyzed the development forms and the potential reasons for the prompt developing non-tariff barriers, in the meanwhile, both the positive and negative effects were pointed out. The writer then made a study on the performs of the trade protectionism, the regulations contained in WTO, and their effects on the trade protectionism, which made up an important part of this paper. Since the World Trade Organization has founded, new agreements were made soon, not only on the new forms of the non-tariff barriers, but also on the former documents included in the GATT. For the most part, this study made a research on the"Anti-Dumping Agreement","Safeguard Measures Agreement"and the"Technical Barrier to Trade Agreement". What is more, by applying to the model of the general balance, the writer analyzed the economics effect on three types of non-tariff barriers. To make the measures correspondingly, this paper mainly investigated the non-tariff barriers in the three most important trade partners of China, and then draws a conclusion for the different types of the non-tariff barriers. Based on these, this paper expound the present situation and characteristics on foreign trade, analyzed the export products, which were confronted with non-tariff barriers, and the reasons why the non-tariff barriers occurred frequently, as the empirical analysis, the representative cases were mentioned. In the end, the strategic measures were brought up.
