Study On Third Party Evaluation System Of Local Legislation

Law is the weapon of ruling the country,and good law is the premise of good governance.To build a socialist legal system with characteristics,we must adhere to legislation first,seize the key to improving the quality of legislation,and play the role of leading and promoting legislation.With the revision of the Legislative Law of the People's Republic of China and the Constitution of the People's Republic of China,the main body of local legislation has been extended to the city of the district.Under the background of the expansion of local legislative subjects,how to improve the quality of local legislation has attracted more and more attention from all walks of life.Third-party evaluation of local legislation is an important institutional guarantee for improving the quality of local legislation.The professionalism and independence of third-party assessment of local legislation is also the guarantee of the impartiality of third-party assessment results.However,in reality,the research on third-party evaluation systems is not comprehensive and specific,whether at the theoretical research,institutional level or practice level.In response to this problem,it is particularly important to introduce third-party assessments in local legislation.In this paper,this paper hopes to find out the problems existing in the third-party evaluation system of local legislation,and proposes to improve the third-party evaluation system of local legislation.First,a theoretical basis study on third-party assessment of local legislation.Determine the concept of “local legislation” and “third-party assessment of local legislation”;clarify the principles of third-party assessment of local legislation,including objective and fair principles,scientific principles,democratic principles,and open principles;and discuss the significance of third-party assessments of local legislation,including the promotion of local legislation Quality,curbing the “ departmentalization ” tendency of local legislation,and broadening the channels for public participation in local legislation.Then,in the theoretical basis research of the third-party evaluation of local legislation,through the study of the institutional composition of the third-party assessment of local legislation,determine the subject of third-party evaluation of local legislation,third-party evaluation content,third-party evaluation criteria and third-party evaluation procedures.Wait.Then,through the research on the third-party evaluation system of local legislation,the current situation of the third-party evaluation system of local legislation is explored and the problems of the third-party evaluation system of local legislation are found.The problems existing in the third-party evaluation system of local legislation are mainly due to the lack of a relatively uniform third-party evaluation system,the insufficiency of the qualifications of third-party evaluation agencies,the incompleteness of third-party assessments,and the incompleteness of third-party evaluation procedures.Finally,in view of the problems existing in the third-party evaluation system of local legislation,the suggestions for improving the third-party evaluation system of local legislation in China are proposed,including the establishment of a relatively unified third-party evaluation system,the improvement of the qualification requirements of third-party evaluation agencies,and the improvement of third-party evaluation contents.And improve the third party evaluation process.
