On Governace Reform Of Local Government Based On Transition Of Power Structure

In the transformation period of China,local governments have promoted a great deal of governance innovation in the process of governance reform.This attempt is bound to transform the power structure from a stable static model to a developing dynamic one.Scholars have been reflecting upon how to implement governance reform among local governments effectively,and many researches have attempted to analyze all kinds of problems that have arisen in the reform from the perspective of power structure.To this issue,it's widely held in the academic circle that local government innovation in any form will certainly lead to the breakdown of existing power structure.However,existing researches have not yet had a systematic explanation on the internal connection between the transformation of power structure and governance reform of local governments,as a result of which,research topics like"what's the relationship between the two","how do they influence each other",and"how to make a guidance to their relationship development" are worth considering.According to the theoretical and practical demand,this research analyzes the governance of local governments under the centralized power structure from the perspective of power structure,so as to reveal the inevitability of power structure transformation in the process of local governance reform.Moreover,a systemic analysis of this reform under the centralized power structure is made before a case study on analyzing the law of power structure transformation under the centralized power structure among the three typical pathways(the path of "Local Government innovation",the path of "Province directly Governing Counties Reform",and the path of "Development Zone")and the three typical patterns(the "Commission-company"pattern,the "Project management" pattern,and the "Land-financial-finance"pattern)of local governance reform.In the case studies above,various kinds of relations between the power structure transformation and local governance reform are fully analyzed,so as to discuss problems in the process of transforming from the centralized power structure to the legalized one at macro level.Several viewpoints are included in this research:Firstly,the subject element and behavior element of power structure are two key factors that may influence the governance reform among local governments.As a result,the transformation of power structure must be the transformation to the plural and equal subject first.The important precondition of realizing the goal of governance reform is to break the controlling relationship,game relations and collusive relations which formed under the under the centralized power structure.The subject element and behavior element can only transform by virtue of power structure transformation.Secondly,local governance reform under the centralized power structure chooses an incremental path,which cannot solve the public governance dilemma brought by the illegal treatment in local governments' allocation of authority.The governance-oriented local government reform is severely constrained by the centralized power structure,which has brought problems like unclear power boundaries,serious conflicts among power hierarchy,and power's restriction on market development.To solve these problems should start with the transformation of power structure.Thirdly,the practice of local governance transformation under the centralized power structure not only makes a breakthrough of existing power structure,but also falls into a trap of the new power structure.The three pathways and three patterns of local governance reform are all challenges to the current power structure,and all achieve breakthroughs in the current power structure in a certain period and in certain extent,but all of them are palliative.Fourthly,to ensure the effectiveness of local governance reform,the breakthrough of subject element should be made first,which means to change the design power subject system so that the power decision and operation mechanism can transform from "ruling by man" to "ruling by law".On the other hand,the action strategies of power subjects should also be transformed from the behavioral pattern of controlling,game and collusion to the pattern of equal dialogue constructed according to the law.
