The Verification-reduction Standard And System Design Of Subsided Farmland In High Groundwater Coal Mines

China is rich in coal resources reserves,at the same time,China is also the biggest coal producer and big coal consumer of the word,the output of coal accounts for about 70% of total energy production.However,with the continuous increasing of coal production,there are a serious of severe problems about ecological environment destruction in mining area,farmland damage in overlapped area of farmland and coal resources,difficult restoration of coal mining subsidence with high groundwater level,huge pressure on farmland protection from local government.At present,relevant researches and policies about subtracted losses are absent,besides,limited by the current task of farmland index,local government cannot subtract the quantity and change the use,causing a serious inconformity of "figure,number and field" of farmland in coal mining and affecting the control of central government for farmland information in mining area timely and dynamically.There is a tripartite contradiction among local government,land-lost farmer and coal enterprise,which affecting thesocial stability in mining area,and restricting the coordinative development of geology and mining,thus,enacting the policy of damaged farmland subtracted losses is imperative.Based on the wide literature review and large data collection,this research regards the coal mining subsidence with high groundwater level as object,through adopting a combination method of qualitative and quantitative analysis method,analyzing problems of the current policy and proving the necessity of damaged farmland subtracted losses.And then,defining the identified method and subtract standard of coal mining subsidence;designing the policy content and establishment method;affirming examination methods and procedures;formulating supervision method of damaged farmland subtracted losses.This research analyses the composite situation of coal and grain and the destructive characteristic of farmland in coal mining subsidence with high groundwater level,summarizes relevant policies of coal mining subsidence farmland in some typical provinces(Shandong,Anhui and Jiangsu),and points out the common problems of the coal mining subsidence under the condition of current policies;defining the connotation of damaged farmland subtracted losses,pointing out two kinds of function objects,establishing the principles of subtracted losses for reclamation and non-reclamation subsidence under incomplete transfer mode,and analyzing the necessity of damaged farmland subtracted losses from three aspects of government,coal enterprise and land-lost farmer;according to relevant policy about disaster farmland and ecological restoration policy,enacting the subtracted losses policy.Introducing the foundation,principle,procedure and content of policy design emphatically,analyzing the examination and approval system of subtracted losses policy,elaborating from three aspects about operating mechanisms,submitting materials and following principle and criteria,besides,in order to satisfy the management of coal mining area,subtract losses and approve truly,putting forward suggestions for information construction about subtract losses policy innovatively,which provides technical guarantee for the policy;defining the basis and reasons of policy regulation,and analyzing the constitution of supervision department,besides,after considering the illegal disciplinary problemspotentially,elaborating the main contents and responsibility investigation ways of policy supervision from two problems about over-subtracted and illegal reimbursement.Through researching the specific,the main results are concluded as follows:(1)Recently,there is no channel to subtract losses,the farmland protection pressure is huge;the incomplete expropriation compensation mode cannot solve social insurance problems of the land-lost farmer;there is a huge funding pressure on coal mine enterprises because of multiple tax burden.(2)The objects of the subtract losses policy are two kinds of subsidence farmland,one is thestable subsidence farmland that unable to restored to grain production capacity but to other use,the other one is the stable subsidence farmland that have not be restored.(3)The subtract losses policy learned from relevant policy about disaster farmland and ecological restoration policy,defining the principle of protect farmland and the principle of balancing equity among governments,coal enterprises and land-lost farmers,the main contents of the policy include that identifying the loss farmland by dividing farmland damage grade and determining the subtract losses scope of the subsidence farmland;approving the policy by declaring step-by-step and expert argumentation from bottom to up,and one-off subtract,year-divided subtract and batch-divided subtract from top to bottom.;compensating from government aspect and enterprise aspect;guaranteeing the farmland safe through new ways of "requisition-compensation balance",supervising the policy aiming at over-subtract and illegal reimbursement.(4)The approve of subtract losses should be strength in the planning and project about macro management and control from national level,and make a full decentralization to the local government depend on information method in which the government can collect and escalate information,and be classified as one-off subtract,year-divided subtract and batch-divided subtract from top to bottom according to the result from expert's argumentation;for the coal mining subsidence land from now on which the local government should be in charge of coming up with coal-mine plans and predicting the view of coal mining subsidence land,according to the experts' argumentation,the government will make out a annual plan on the farmland subtracted losses,and issued by the local government,regulate the use of land annually.(5)Through build a regulative department,association and perfect regulatory structures.the obligation of the government will be strengthened,the over-subtracted and illegal reimbursement should be held accountable.
