Research On Citizen Participation Consciousness From The Perspective Of Rule Of Law

The construction of the rule of law in China not only means the improvement of the national static legal system,but also heralds the construction of the country's rule of law implementation system and the benign operation of the dynamic mechanism;it not only means that the national public authority should promote the national governance system and governance ability by thinking mode and way of the rule of law,but also means that citizens should be actively involved in national social governance from the cultivation of citizen participation consciousness.Citizen participation,as a modern and emerging form of democracy,is an important way to effectively restrict public power and realize the legalization of civil rights.Citizen participation consciousness is the psychological refraction of citizen participation practice.It plays a fundamental supporting role in the realization of citizen's participation right in the practice of democracy and rule of law in contemporary China.It can be said that the cultivation of citizen participation consciousness has the potential enlightenment of consciousness and recovery function for the citizens to participate in the national governance and realize the system construction of popular sovereignty.Only the promotion of the participation of all citizens and the integration of the concepts of values like equality,freedom behind the “democratic participation” of modern democracy and traditional Chinese culture give rise to the identification and acceptance of the democratic and legal concept of citizen participation by the entire society,and practice the conscious action of “citizen participation”,which can really protect the realization of citizen's participation rights by the measures of the rule of law.The Citizen Participation consciousness is the concrete manifestation of the abstract human consciousness,which itself should conform to the content composition and expression form of the consciousness in the general sense,and follow the formation and activity laws of human consciousness itself.According to Marxist philosophy,consciousness is the special function of objective existence reflected in the human brain.Social existence determines social consciousness and social consciousness reflects social existence.Therefore,the connotation,composition,and object of Citizen Participation consciousness should have its specific content.Citizen Participation consciousness is a conscious perception of citizens' participation rights and participation behaviors,as well as a rational subjective reflection of their own relations with the state.It takes the citizen's subject personality,participation psychology and participation concept as the constituent elements,and emphasizes the psychological elements such as participation,participation motivation,participation emotion and participation attitude.Based on this connotation and substance,the Citizen Participation consciousness has its unique value function for the construction of modern law.It provides important ideological support for the construction of citizen culture,the achievement of the country's good governance,and the realization of civil rights.The generation of citizen participation consciousness is not a simple process.Through the writings of natural law school,utilitarian school of law,Marxism,and some other thinkers,we can understand some of the theoretical origins of this issue in the history of the social history.The development of citizen participation consciousness is not a natural process,but is complicated by a series of complex social and historical conditions,especially subject to specific conditions of rule of law,governance model,market economy,and political culture.In addition,the identities and cognition of individual citizens also influence the development of citizen participation consciousness to some extent.The participation of Chinese citizens has undergone a tortuous historical evolution from early exploration,to the setback of freshmen,and to the opening of the future.Citizen Participation gradually penetrated into the fields of legislation,administration,and judicature from simple political participation;the main body of citizen participation was gradually extended to the general public by elites such as representatives to the National People's Congress,members of the Chinese People's Political Consultative Conference,experts and scholars.In particular,the 19 th National Congress of the Communist Party of China once again clarified the era proposition of the modernization of the country's governance,considered good governance as an ideal state for the pursuit of state governance,emphasized the positive interaction between the state and citizens,and advocated the organic integration of the state and citizens.At the same time,it also pointed out that “protecting the people's right to know,participate,express,and supervise” should be used to clarify Citizen Participation in the form of civil rights.It can be said that the socialist democratic and legal system with Chinese characteristics is increasingly perfect.However,there is a non-optimism fact before us that can't avoid.Due to political,economic,cultural,historical and other factors,the current level of citizen participation consciousness can not adapt to the new situation of the current Citizen Participation in the development of practice,but can not adapt to the need for democracy and the rule of law.The disconnect between consciousness,system,and behavior has led to the current difficulties in the construction of the rule of law in China.It has not only seriously affected the stability and harmony of the society,but also greatly hindered the improvement of the citizens' own quality and hindered the enthusiasm of citizens to participate in national governance and the rule of law.To fundamentally overcome the various problems that currently arise,citizens must be made aware of their participation.Through the construction of the rule of law itself,we must use the rule of law to affirm participation rights,stimulate participation,improve participation,and standardize participation in order to promote the development of Citizen Participation.Through the institutionalization of construction,the cultivation of Citizen Participation vehicles and the necessary propaganda and education of the rule of law to reshape the external promotion mechanism of citizen participation consciousness.Only by establishing a system of legal protection for citizens' consciousness of participation,can it be possible to reach an appropriate state of participation awareness,so that “participation” becomes a living habit,a universal behavior of citizens,and even a universal belief of citizens,infiltrating in all aspects of social life.The consciousness of citizen participation is constructed as the conceptual basis and cultural nutrients for the construction of democracy and the rule of law.In order to realize the popular sovereignty through the citizens participation in the governance of the country,China must take seriously the issue of citizen participation.As an abstract existence,participation consciousness is always accompanied by the daily behavior of citizens,and closely linked.Citizens' behavior selection is often an important criterion for evaluating their participation consciousness.Therefore,the research on citizen participation must pay close attention to and give in-depth exploration to citizen participation behavior itself.In modern society,there is an inseparable relationship between the consciousness of citizen participation and the construction of the country's legal system.Only through strictly enforcing the rule of law,citizens have the opportunity to experience the practice of “participation” and experience the glory of “participation” and institutional superiority in the experience of participation,thereby recognizing “participation” and forming an inner confirmation to reach the level of citizens participation consciousness and promote the normalization and habituation of participation rights,and guaranteed by the way of the rule of law,so that “participation” becomes a mode of thinking and way of life under the rule of law.
